Title:Diskriminacija v policijski postopkih : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V diplomskem delu smo preučevali, kaj je postopek profiliranja, kdo ga sme izvajati in kaj sledi, če so med postopkom ugotovljene nepravilnosti, ki se naslanjajo na diskriminacijo. Ker je policija varnostni organ, ki ima poleg drugih državnih in nadzornih varnostnih organov največ razlogov za izvajanje postopka identifikacije, se ravno pri njih pojavlja največ primerov nepravilne uporabe pooblastil, ki so jim dodeljena. Cilj diplomske naloge je navedba zakonske podlage za izvajanje postopkov identifikacije, povzetek različnih načinov profiliranja in ugotavljanje kršitev pravic obravnavanih med postopki. Naslednji cilj je bil, da poudarimo problem diskriminacije, ki se dogaja v vsakdanjiku, kjer smo kot del enakopravne družbe lahko krivično obravnavani zaradi raznih osebnih lastnosti. V empiričnem delu diplomske naloge smo opisali pomen etničnega profiliranja, njegovo nezakonitost in vpliv, ki ga ima na družbo. Navedli smo poročila o diskriminaciji na konkretnih primerih, ko so pooblaščeni varnostni organi kršili zakon o diskriminaciji in osebne pravice obravnavanih z nepravilnimi izvajanji postopkov identifikacije. V zadnjem delu diplomskega dela smo potrdili ali ovrgli predpostavke oziroma hipoteze. Ugotovili smo, da diskriminacija v Sloveniji še zmeraj predstavlja pravno moralni, politični in varnostni problem, saj je nerešenih in nepojasnjenih ogromno primerov. Odnos večine Slovencev kot tudi organov do družbeno različnih skupin je precej nestrpen in predstavlja problem družbene diskriminacije na več področjih. Kljub družbenemu napredku, napredku znanja in tehnologije ljudje še zmeraj ne znamo izločiti svojih predsodkov in sprejeti preprostega dejstva: vsi drugačni, vsi enakopravni.

Title:Discrimination in police stops
Abstract:In thesis we studied what profiling process is, who is allowed to carry it out and what follows if irregularities based on discrimination are identified during the procedure. As the police are the security authority that, in addition to other state and supervisory security authorities, has the most reasons for carrying out the identification process, they are the ones who have the most cases of improper handling of the powers granted to them. The aim of the diploma thesis was to indicate the legal basis for the implementation of identification procedures, a summary of the various methods of profiling and, most important, that the implementation of the procedures does not violate the rights of those involved. The next goal was to highlight the problem of discrimination that occurs in everyday life, where as part of an equal society we can be treated unfairly because of various personal characteristics. In the empirical part of the thesis, we described the importance of ethnic profiling, its illegality and the impact it has on society. We listed reports of discrimination in specific cases where authorized security authorities violated the law on discrimination and the personal rights of the victim by improperly conducting the identification process. In the last part of the thesis, we confirmed or refuted the assumptions or hypotheses. We found that discrimination in Slovenia is still legal, political and security problem as there are many unresolved and unexplained cases. The attitudes of the majority of Slovenes as well as the authorities towards socially diverse groups are quite intolerant and represent a problem of social discrimination in several areas. Despite the social progress of knowledge and technology people still do not know how to eliminate their prejudices and accept a simple fact: everyone is different, everyone is equal.
