Title:Virtualna otroška pornografija in njena problematika : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomska naloga obravnava področje virtualne otroške pornografije in njene pravne in etične pomisleke. Virtualna otroška pornografija ali simulirana otroška pornografija pomeni, da otrok ni resničen oziroma je na fotografiji virtualen ali simuliran. Gre za eksplicitne slike, ki prikazujejo mladoletnika, vendar so ustvarjene brez vpletenosti resničnih oziroma dejanskih otrok (Mains, 2010). V prvem delu diplomske naloge obravnavam definicijo virtualne otroške pornografije in jo predstavim. Definiram njen pojem, predstavim problematiko, ki jo predstavlja, ter opišem nekaj najzanimivejših primerov iz te teme, ki jo najdemo na tujih tleh. V drugem delu diplomske naloge se bolj osredotočim na zakonodajo in pravne zadeve glede virtualne otroške pornografije. Predvsem se navežem na državo Slovenije, Japonske, Nizozemske in ZDA. Opazim lahko, da zakonodaja pri nobeni državi ni enako urejena in da je urejenost glede virtualne otroške pornografije pravno sporna predvsem v ZDA in na Japonskem. Glede Slovenije in Nizozemske pa lahko opazimo, da se zakonodaja razvija v pozitivni smeri. V osrednjem delu diplomske naloge predstavim primer Sweetie 2.0. Sweetie predstavlja desetletno filipinsko deklico, ki jo upravlja agent nizozemske organizacije za pravico otrok Terre des Hommes. Glavni cilj organizacije je s pomočjo avatarja Sweetie uloviti posameznike, ki bi zahtevali seks preko spletne kamere. Pojavi pa se vprašanje ali je iz etičnega in pravnega vidika to početje spremenljivo. Nato sem raziskala in predstavila še najodmevneješe primere iz ZDA, kjer se je okoli virtulne otroške pornografije veliko stvari odvijalo na sodiščih. Gre se o Zakonu za preprečevanje otroške pornografije v ZDA. Predstavim njen razvoj, probleme in postopek sprejemanja tega Zakona na sodišču. V zadnjem delu diplomske naloge predstavim in preverim postavljene hipoteze. Za analiziranje svojih hipotez sem uporabila analitično raziskovalno metodo. S kritičnim razmišlanjem in vrednotenjem dejstev, povezanih z virtualno otroško pornografijo sem nato z analiziranjem podprla oziroma zavrgla postavljeno hipotezo. Svoje hipoteze sem preverjala s pomočjo študij in raziskav, ki so bile opravljene. Prvo in tretjo hipotezo sem potrdila, medtem ko sem drugo hipotezo delno potrdila.

Title:Virtual child pornography and it's contemporary problems
Abstract:The thesis deals with the area of virtual child pornography and its legal and ethical concerns. Virtual child pornography or simulated child pornography means that the child is not real, or is virtual or simulated in the photograph. These are explicit images depicting a minor, but created without the involvement of real or actual children (Mains, 2010). In the first part of the thesis, I discuss and present the definition of virtual child pornography. I define its concept, present the issues it raises, and describe some of the most interesting examples of this topic found on foreign soil. In the second part of my thesis, I will focus more on the legislation and legal issues surrounding virtual child pornography. I refer in particular to the countries of Slovenia, Japan, the Netherlands and the USA. I can see that no country has the same legislation and that the regulation of virtual child pornography is legally controversial, especially in the USA and Japan. As regards Slovenia and the Netherlands, we can see that legislation is developing in a positive direction. In the main part of the thesis, I present the case of Sweetie 2.0. Sweetie is a 10-year-old Filipino girl who is managed by an agent of Terre des Hommes, a Dutch children's rights organisation. The main aim of the organisation is to use Sweetie's avatar to catch individuals requesting sex via webcam. The question arises whether, from an ethical and legal point of view, this is a variable. Then I researched and presented the most prominent cases from the US, where a lot has been happening in the courts around viral child pornography. It is about the Child Pornography Prevention Act in the USA. I will outline its development, its problems and the process of passing this Law in court. In the last part of the thesis, I present and test the hypotheses. I used the analytical research method to analyse my hypotheses. By thinking critically and evaluating the facts related to virtual child pornography, I then analysed them to support or reject the hypothesis. I have tested my hypotheses through studies and research that have been carried out. I confirmed the first and third hypotheses, while the second hypothesis was partially confirmed.
