Title:Pravni vidiki umeščanja v prostor na primeru Sončne elektrarne Zlatoličje - Formin : magistrsko delo

Abstract:Globalno segrevanje in podnebne spremembe so prepoznane kot resnična skrb, zato se pozornost načrtovalcev in operaterjev elektroenergetskega sistema osredotoča na uporabo alternativnih energetskih tehnologij z nizkimi emisijami za proizvodnjo električne energije. OVE imajo veliko prednost vključno z zmanjšanjem podnebnih sprememb, povečanjem trajnosti v energetskem sektorju in povečanjem zanesljivosti oskrbe z energijo. Za prehod v nizkoogljično družbo in pridobivanje OVE je potrebno energetske objekte OVE umestiti v prostor. Postopek umeščanja energetskih objektov OVE v RS poteka skladno z določbami ZUreP-3, ki je bil leta 2021 noveliran, uporablja pa se od 1. junija 2022. ZUreP-3 ohranja vsebino, že uveljavljene pojme in strukturo prej veljavnega zakona ZUreP-2 ter ga nadgrajuje, kljub temu pa prinaša številne in obsežne spremembe. Pripravljen je z namenom doseganja ciljev trajnostnega prostorskega razvoja, učinkovitega upravljanja s prostorom, z namenom optimizacije in učinkovitejšega vodenja postopkov. Za gradnjo energetskih objektov ločimo prostorske ureditve lokalnega pomena, za katere je pristojna občina, v območju katere leži načrtovana prostorska ureditev in prostorske ureditve državnega pomena, za katere je pristojna država. Elektrarne z nazivno močjo najmanj 10 MW ali več spadajo med prostorske ureditve državnega pomena in se načrtujejo z DPN. Prostorske ureditve državnega pomena so lahko tudi druge ureditve, če vlada na predlog ministrstva, v pristojnost katerega spada prostorska ureditev, po predhodnem mnenju Komisije za prostorski razvoj ugotovi, da gre za tako prostorsko ureditev, ki je zaradi svojih gospodarskih, socialnih, kulturnih in varstvenih značilnosti pomembna za razvoj RS. Pri načrtovanju umestitve energetskih objektov v prostor, je potrebno upoštevati varstvene zahteve in omejitve, ki izhajajo iz t.i. sektorskih predpisov. Gre za predpise, ki se nanašajo na ohranjanje narave, kulturne dediščine, varstvo okolja, vod in drugih. RS ima ogromno potenciala za uvajanje OVE, vendar postopek umeščanja naleti prav na težave, povezane z naravovarstvenimi vidiki. Predstavljen postopek umeščanja SE Zlatoličje – Formin poteka po postopku DPN in želi prispevati k zanesljivi, trajnostni in konkurenčni oskrbi z energijo ter povečanju oskrbe z energijo iz OVE. Načrtovana SE Zlatoličje - Formin leži v vzhodnem delu Slovenije, na umetnih kanalih hidroelektrarn med Zlatoličjem in Forminom, vzhodno in zahodno od mesta Ptuj. Sončna elektrarna se bo raztezala na brežine derivacijskih kanalov dveh hidro elektrarn (HE Formin in HE Zlatoličje). Sega v območje varstva kulturne dediščine, vodovarstvena območja, poplavna območja in območja posebnih varstvenih režimov ohranjanja narave, zato je potrebno že v pobudi DPN opraviti analizo stanja. Končni datum pričetka obratovanja SE Zlatoličje je predviden 2. maja 2025, SE Formin pa 2. maja 2026. V postopku umeščanja energetskih objektov OVE v prostor, se udeleženeci soočajo z mnogimi ovirami. Pomembno je, da te ovire premagamo in omogočimo čim boljši in hitrejši razvoj novih proizvodnih virov OVE tudi zavoljo energetske revščine, ki nam sledi.

Title:Legal aspects of Placement procedure of Energy facilities in Physical space featuring the Placement procedure of Solar Power Plant Zlatoličje - Formin
Abstract:Global warming and climate change are recognized as a real concern, so the attention of power system planners and operators is focused on the use of alternative energy technologies with low emissions for power generation. RES have many advantages, including reducing climate change, increasing sustainability in the energy sector and increasing the reliability of energy supply. In order to transition to a low-carbon society and obtain RES, it is necessary to place RES Energy facilities in the physical space. The procedure for the Placement of renewable Energy facilities in the Republic of Slovenia is carried out in accordance with the provisions of ZUreP-3, which was amended in 2021, and is applicable from June 1, 2022. ZUreP-3 preserves the content, already established terms and structure of the previously valid ZUreP-2, but nevertheless brings numerous and extensive changes. It is prepared with the aim of achieving the goals of sustainable spatial development, effective management of space, with the aim of optimizing and more efficiently managing procedures. For the construction of energy facilities, a distinction is made between Spatial planning of local importance, for which the municipality in whose area the planned Spatial arrangement lies is competent, and spatial planning of national importance, for which the state is competent. Power plants with a nominal power of at least 10 MW or more belong to spatial planning of national importance and are planned with DPN. Spatial regulations of national importance can also be other regulations, if the government, on the proposal of the ministry under whose jurisdiction the spatial regulation falls, determines, according to the preliminary opinion of the Commission for Spatial Development, that it is such a spatial regulation, which due to its economic, social, cultural and protective characteristics important for the development of the Republic of Slovenia. When planning the placement of Energy facilities in the physical space, it is necessary to consider the protection requirements and restrictions arising from the so-called sectoral regulations. These are regulations relating to the preservation of nature, cultural heritage, protection of the environment, water and others. The Republic of Slovenia has a huge potential for the introduction of RES, but the placement process encounters problems related to nature conservation aspects. The presented procedure for the placement of Solar Power Plant Zlatoličje – Formin is carried out according to the DPN procedure and aims to contribute to a reliable, sustainable and competitive supply of energy and an increase in the supply of energy from RES. The planned Solar Power Plant Zlatoličje - Formin is in the eastern part of Slovenia, on artificial channels of Hydroelectric Power Plants between Zlatoličje and Formin, east and west of the city of Ptuj. The Solar Power Plant will extend to the banks of the derivation channels of two hydro power plants (Hydroelectric Power Plants Formin and Zlatoličje). It extends into the area of cultural heritage protection, water protection areas, flood zones and areas of special protection regimes for nature conservation, so it is necessary to carry out an analysis of the situation already in the DPN initiative. The final date for the start of operation of Solar Power Plant Zlatoličje is scheduled for May 2, 2025, and Solar Power Plant Formin for May 2, 2026. In the process of placing RES energy facilities in the physical space, the participants face many obstacles. It is important to overcome these obstacles and enable the best and fastest possible development of new renewable energy sources, also for the sake of the energy poverty that is approaching.
