Title:Ugotavljanje verodostojnosti informacij, pridobljenih med preiskovalnim intervjujem : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Učinkovito preiskovalno zaslišanje je v središču vsake policijske preiskave in je zato temelj doseganja pravičnosti v družbi. To je zato, ker so ključni cilji, na katerih temelji vsaka preiskava ugotoviti, kaj se je zgodilo, in če se je kaj zgodilo odkriti, kdo je kaj storil, ter zbrati dokaze na način, ki bo verodostojen za tiste, ki odločajo. Da bi to dosegli, morajo preiskovalci zbrati informacije, katerih vir je običajno oseba (npr. priča, žrtev, osumljenec itd.). Ko se soočajo z osebo, ki govori resnico, želijo zbrati dovolj informacij, da to resnico potrdijo. Ko se soočajo z lažnivcem, je njihova naloga omogočiti, da se laž razkrije dovolj podrobno, da se lahko dokaže njeno neresničnost. V vsakem primeru se naloga preiskovalcev opira na kombinacijo učinkovitega intervjuja, branja ljudi in ocene verodostojnosti. Ali so strokovnjaki vešči teh nalog? Če ne, zakaj? Kaj znanost predlaga, da bi morali posamezniki narediti, da bi natančno ocenili, če nekdo govori resnico ali vsaj izboljšali svojo sposobnost ocenjevanja verodostojnosti informacij? V tej kvalitativni nalogi so na ta in druga vprašanja ponujeni odgovori na podlagi raziskav in mnenj strokovnjakov s tega področja. V naslednjih poglavjih so opredeljeni osnovni pojmi laži, njena vloga v kazenskem postopku ter verbalni in neverbalni kazalniki, ki lahko pripomorejo k njenemu odkrivanju. Kasneje se razpravlja o pomenu ustreznega intervjuja za oceno verodostojnosti pridobljenih informacij. Na koncu se preuči obetaven sistem ocenjevanja kriterijev za presojo zavajanja ACID, ki pripomore k izboljšanju spominjanja intervjuvancev in s tem k lažjemu odkrivanju zavajanj tekom preiskovalnega intervjuja. Kljub pomanjkljivostim metode so raziskovalci mnenja, da je le-ta uporabno orodje v rokah usposobljenega preiskovalca. V Sloveniji se zaradi nepoznavanja metoda še ne uporablja, je pa gotovo povsem uporabna in priporočljiva tudi v našem kulturnem okolju.

Title:Detecting credibility of the information sourced during the investigative interview
Abstract:Effective investigative interviewing is at the heart of any police investigation and is therefore fundamental to achieving justice in society. This is because the key objectives underpinning any investigation are to find out what happened and, if something did happen, to discover who did what, and to gather evidence in a way that is credible to decision-makers. To achieve that, investigators must collect information, usually from individuals (e.g. a witness, a victim, a suspect, etc.). When they are confronted with a person who is telling the truth, they want to gather enough information to corroborate that truth. When confronted with a liar, their task is to allow the lie to be exposed in sufficient detail to prove its falsity. In each case, the investigators' task relies on a combination of effective interviewing, reading people, and assessing credibility. Are professionals skilled in these tasks? If not, why not? What does science suggest that individuals should do in order to accurately assess whether someone is telling the truth, or at least to improve their ability to assess the credibility of information? This qualitative study offers answers to these and other questions based on research and the opinions of experts in the field. The following sections define the basic concepts of lying, its role in criminal proceedings, and the verbal and non-verbal indicators that can help to detect it. Later, the importance of a proper interview to assess the credibility of the information obtained is discussed. Finally, a promising scoring system for the ACID deception assessment criteria is examined to help improve interviewees' recall and thus facilitate the detection of deception during an investigative interview. Despite the shortcomings of the method, the researchers consider it to be a useful tool in the hands of a trained investigator. It is not yet used in Slovenia because of its unfamiliarity, but it is certainly quite useful and recommended in our cultural environment.
