Title:Pravica do minimalne plače : magistrsko delo

Abstract:Magistrsko delo podrobneje proučuje institut minimalne plače v Republiki Sloveniji in njegov vpliv ter pomen v luči mednarodnih in nacionalnih pravnih virov. Na tej podlagi je podrobneje analizirana pravica do minimalne plače s poudarkom na ugotavljanju skladnosti slovenske ure-ditve s standardi, ki jih določajo mednarodni dokumenti in pravo EU ter pravnih vprašanjih, povezanih z njeno določitvijo ter njenim uveljavljanjem. Ustrezna minimalna plača je ključnega pomena za vzpostavitev ustreznih delovnih in življenj-skih pogojev ter doseganja skupne blaginje, kar na mednarodno pravni ravni izpostavljajo predvsem konvencije, sprejete v okviru Mednarodne organizacije dela (MOD). Z vidika mini-malne plače sta pomembni predvsem Konvencija MOD št. 131 in njena predhodnica Konven-cija MOD št. 26, ki je kot »mati« instituta minimalne plače postavila temelje in podlago siste-ma določanja minimalne plače. Slednje, tako kot nedavno sprejeta Direktiva, ne določajo viši-ne (ustreznih) zneskov minimalnih plač, temveč zgolj kriterije za njeno določitev. V sklopu splošno sprejetih načel mednarodnega prava je minimalna plača vezana na tako ime-novani »prag dostojnosti« (decency threshold). V zvezi s slednjim je ključnega pomena Evrop-ska socialna listina-spremenjena (4. člen MESL). Slednja je poleg Evropskega stebra Socialnih pravic (alineja (b) 6. člena), ena izmed redkih, ki izpostavlja pomen tovrstnega mednarodnega standarda, ki neposredno naslavlja vprašanje pravičnega minimalnega plačila. Na nacionalnem nivoju je minimalna plača urejena z Zakonom o minimalni plači (ZMinP), ki je v okviru svoje geneze bil večkrat (ne)uspešno spremenjen. V okviru nazadnje sprejete novele ZMinP-B (nedaven predlog novele ZMinP-C ni bil sprejet), so bile med drugim spremenjene določbe, ki se navezujejo na ne-vštevanje dodatkov v znesek minimalne plače. V skladu s slo-vensko zakonodajo se znesek minimalne plače vsako leto uskladi najmanj z rastjo cen življenj-skih potrebščin. Z vidika kolektivnih pogodb magistrsko delo obravnava tudi vprašanje strukture plač in raz-merja med višino minimalne plače ter višino najnižje-osnovne plače, kot jo določajo posamezne panožne kolektivne pogodbe. V tej zvezi se postavlja ključno vprašanje višine zneska najnižje osnovne plače posameznega tarifnega razreda iz različnih kolektivnih pogodb napram trenutno določenem znesku minimalne plače v Republiki Sloveniji in uravnilovke, do katere prihaja za-radi tega. Z vidika prava EU pravico do minimalne plače uokvirja nedavno sprejeta Direktiva Evropske-ga parlamenta in Sveta o ustreznih minimalnih plačah v Evropski uniji. Slednja predstavlja temelje in okvirne cilje, ki jih bodo države članice morale implementirati v svojo nacionalno zakonodajo s področja sistema urejanja minimalnih plač. V zvezi s postopkom implementacije Direktiva prav tako ne predstavlja podlage, ki bi državam članicam omogočala, da znižajo že zagotovljene nacionalne sisteme pravnega varstva. Cilj Direktive prav tako ni v spremembi obstoječih sistemov ureditve minimalnih plač držav članic EU, temveč v prilagoditvi in izbolj-šanju obstoječih. Pri tem je ključno tudi vprašanje skladnosti slovenske ureditve z vsebino in cilj sprejete Direktive.

Title:The right to a minimum wage
Abstract:The master's thesis examines the minimum wage institute in the Republic of Slovenia and its impact and importance in the light of international and national legal sources. On this basis, the right to a minimum wage is analysed in more detail with an emphasis on determining the compliance of the Slovenian regulation with the standards set by international documents and EU law, as well as legal issues related to its determination and enforcement. Adequate minimum wages are of key importance for the establishment of appropriate working and living conditions and the achievement of common prosperity, which is highlighted at the international legal level mainly by conventions adopted within the framework of the Interna-tional Labour Organization (ILO Conventions). From the point of view of the minimum wage, the MOD Convention no. 131, and its predecessor MOD Convention no. 26, which, as the »mother« of the minimum wage institute, laid the foundations and basis of the minimum wage determination system. The latter, like the recently adopted Directive, does not determine the amount of (appropriate) minimum wages, but only the criteria for its determination. As part of the generally accepted principles of international law, the minimum wage is tied to the so-called decency threshold. In relation to the latter, the European Social Charter-Revised (Article 4 MESL) is of key importance. The latter, in addition to the European Pillar of Social Rights (paragraph (b) of Article 6), is one of the few that highlights the importance of this type of international standard that directly addresses the issue of a fair minimum wage. At the national level, the minimum wage is regulated by the Minimum Wage Act (ZMinP), which was (un)successfully amended several times during its genesis. The last adopted amendment ZMinP-B, (the recent proposal of the amendment ZMinP-C was not adopted) changed, among other things, the provisions related to the non-inclusion of supplements in the amount of the minimum wage. In accordance with Slovenian legislation, the amount of the minimum wage is adjusted every year at least to the increase in consumer prices. From the point of view of collective agreements, the master's thesis also deals with the issue of wage structure and the relationship between the amount of the minimum wage and the amount of the minimum-basic wage, as determined by individual industry collective agree-ments. In this connection, the key question is the amount of the minimum basic wage of each tariff class from various collective agreements compared to the currently determined amount of the minimum wage in the Republic of Slovenia and the levelling that occurs as a result. From the point of view of EU law, the right to a minimum wage is framed by the recently adopted Directive of the European Parliament and the Council on adequate minimum wages in the European Union. The latter represents the foundations and framework goals that the member states will have to implement in their national legislation in the area of the minimum wage regulation system. In relation to the implementation process, the Directive also does not represent a basis that would allow member states to reduce the already provided national sys-tems of legal protection. The aim of the Directive is also not to change the existing minimum wage regulation systems of the EU member states, but rather to adapt and improve the exist-ing ones. Here, the question of compliance of the Slovenian regulation with the content and objective of the adopted Directive is also crucial.
