Abstract:	Nadzorstvena dolžnost šole je ena pomembnejših dolžnosti, ki se nalagajo šolam in učiteljem. Kljub temu pa je naša zakonodaja ne definira, zato se je moral pojem natančneje oblikovati skozi sodno prakso. Tako smo prišli do definicije, da je nadzorstvena dolžnost naloga šole, da poskrbi za potrebno varstvo in nadzorstvo nad otroki z namenom, da se prepreči nastanek škode. Obseg nadzora je seveda odvisen od mnogih dejavnikov, kot so starost otrok, duševna zrelost otrok, število nadzorovanih otrok. Nadzorstvene dolžnosti pa šola ni dolžna vršiti le v času pouka, temveč se razteza tudi na čas odmorov, čas šolskih izletov in na čas šolskih prireditev. Čeprav nadzorstvene dolžnosti ne definira nobeden izmed veljavnih zakonskih predpisov, jo vseeno posredno urejajo tako Obligacijski in Družinski zakonik kot Zakon o osnovni šoli ter drugi zakoni, ki urejajo področje izobraževanja v Republiki Sloveniji. Nadzorstvene dolžnosti pa se vseeno ne sme izvajati preveč strogo, saj je učencem treba pustiti dovolj prostora za osebnostni razvoj in samostojnost. Šola za opustitev nadzorstvene dolžnosti odgovarja odškodninsko, učitelj pa je lahko odgovoren tudi disciplinsko ali celo kazensko. Pri presojanju odškodninske odgovornosti šole se uporabijo splošna načela odškodninske odgovornosti, višina prisojene odškodnine pa je odvisna od številnih dejavnikov. Presojanje odgovornosti je oteženo, saj so oškodovanci skoraj vedno mladoletniki. Kazenska odgovornost za opustitev nadzorstvene dolžnosti izhaja izgarantne vloge učitelja, je pa vloga učitelja v kazenskem pravu še posebej zanimiva, saj se v njem prepletajo tako varovalne kot nadzorstvene garantne dolžnosti. Disciplinska odgovornost učitelja nastane na podlagi delovnega razmerja, ki ga ima učitelj sklenjenega s šolo. V Združenem kraljestvu nadzorstvena dolžnost šole izvira iz dejstva, da so otroci šoli zaupani v varstvo, od učiteljev pa se zahteva standard skrbi razumnega starša. V njihovi sodni praksi v zvezi z nadzorstveno dolžnostjo šole pogosto zasledimo pojem »in loco parentis«, kar pomeni namesto starša. Kljub vsemu pa je odgovornost šole za škodo odvisna od okoliščin posameznega primera.

Title:	Schools duty of care
Abstract:	Schools duty of care is one of the most important duties imposed on schools and teachers. Nevertheless, our legislation does not define it, so the concept had to be more precisely formed through judicial practice. This is how we got to the definition that the duty of care is the school's duty to provide the necessary protection and supervision over children, with the aim of preventing harm. The scope of supervision depends on many factors, such as the age of the children, the mental maturity of the children, the number of children supervised. The school is obliged to perform its duties not only during lessons, but also during breaks, during school trips and during school events. Although the schools duty of care is not defined by any of the applicable legal regulations, it is still indirectly regulated by the Obligations and Family Code, the Elementary School Act and other laws that regulate the field of education in the Republic of Slovenia. However, the supervisory duty should not be carried out too strictly, as it is necessary to leave enough space for personal development and independence of the children The school is liable for damages for neglecting duty of care, and the teacher may also be liable for disciplinary or even criminal charges. When assessing the school's liability for damages, the general principles of liability for damages are applied and amount of damages awarded depends on a number of factors. Assessing responsibility is difficult, as the victims are almost always minors. Criminal responsibility for neglecting the duty of care arises from the teacher's guaranty role, but the role of the teacher in criminal law is particularly interesting, as both protective and supervisory guaranty duties are intertwined in it. The teacher's disciplinary responsibility arises on the basis of the employment relationship the teacher has with the school. In the United Kingdom, the school's duty of care is based on a fact that the care for children is entrusted to the school and teachers are required to take the standard of care of a reasonable parent. In their jurisprudence regarding the schools duty of care we often find the term "in loco parentis", which means instead of the parent. Despite everything, the school's responsibility for damage depends on the circumstances of each case.
