Title:Pravice zaposlenih staršev v luči direktive 2019/1158 : magistrsko delo

Abstract:V preteklosti je tradicionalna delitev vlog očeta in matere pomenila, da so se za uveljavljanje starševskega dopusta in pravic do prožnih oblik dela največkrat odločale matere otrok, v zadnjem času pa se spodbujata tudi aktivno sodelovanje obeh staršev pri vzgoji in predvsem »aktivno« očetovstvo. Največje ovire za usklajevanje poklicnega in družinskega življenja zaposlenih staršev so nedvomno neugodni in nepredvidljivi delavniki, saj morajo pretežni del dneva starši preživeti v službi, posledično toliko manj časa preživijo z družino. Vedno hitrejši tempo življenja pa od staršev pogosto terja še večjo pripadnost službi, kot kdaj koli prej. Varstvo pravic zaposlenih staršev že dolgo ne predstavlja zgolj varstva pred odpovedjo in pravic do starševskega dopusta ter nadomestila, vedno bolj pomembne postajajo prožne oblike dela, ki za starše predstavljajo dobro alternativo pri usklajevanju poklicne poti ter družinskega življenja. Direktiva 2019/1158 Evropskega parlamenta in Sveta z dne 20. junija 2019 o usklajevanju poklicnega in zasebnega življenja staršev in oskrbovalcev ter razveljavitvi Direktive Sveta 2010/18/EU na pravni parket Evropske unije prinaša dobro smerno izhodišče za oblikovanje osnovnih pravic zaposlenih staršev, hkrati pa je do posameznih vprašanj novodobne družbe in s tem povezanih vedno novih oblik družin, še vedno precej zadržana, posledično je končni uspeh direktive tako še vedno odvisen tudi od tega, kako posamezna pravna vprašanja ureja notranji pravni red države članice. Sam nabor pravic in ugodnosti za zaposlene starše, ki jih je direktiva 2019/1158 prinesla, pa v slovenski pravni red ne vnaša bistvenih nadgradenj, saj je bil standard urejanja pravic zaposlenih staršev že do sedaj na zelo visokem nivoju, prav tako pa je bogata tudi slovenska sodna praksa.

Title:Rights of working parents in light of the directive 2019/1158
Abstract:In the past, the traditional division of the roles of a father and a mother meant that mothers of children mostly decided to exercise parental leave and the right to flexible forms of work. Recently, however, the active participation of both parents in upbringing and especially “active” fatherhood have been encouraged. Undoubtedly, unfavorable and unpredictable workdays are the biggest obstacles to balancing the professional and family life of working parents because parents have to spend most of the day at work. Consequently, they spend less time with their families. The ever-faster pace of life often demands even greater dedication to work from parents than ever before. For a long time already, the protection of the rights of working parents has not only represented protection against dismissal and the rights to parental leave, as well as compensation. Flexible forms of work are becoming more and more important. For parents, they represent a good alternative for harmonizing career and family life. Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers and repealing Council Directive 2010/18/EU brings to the legal floor of the European Union a good directional starting point for the creation of the basic rights of working parents while at the same time is still quite reserved regarding the individual issues of modern society and the related ever-new forms of families. Consequently, the final success of the directive, thus, still depends on how individual legal issues are regulated by the internal legal order of the member state. However, the set of rights and benefits for working parents brought by Directive (EU) 2019/1158 does not introduce significant upgrades into the Slovenian legal system because the standard of regulating the rights of working parents has been at a very high level until now. Additionally, Slovenian case law is also rich.
