Title:Otroške poroke kot oblika zlorabe pravic otrok : magistrsko delo

Abstract:Otrokove pravice so dandanes na veliki preizkušnji. Kljub vedno večjemu številu ukrepov za varovanje otrok in njihovih pravic, se na eni strani vedno znova pojavijo ovire, katere uresničevanje otrokovih pravic postavijo na rob. Na drugi strani pa imamo ovire, katerih kljub naporom ne moremo izkoreniniti. Ena izmed takšnih ovir so otroške poroke. Ta škodljiva praksa se pojavlja po celem svetu, tako v razvitih kot manj razvitih okoljih, saj je globoko zakoreninjena v tradicionalni kulturi. Otroške poroke danes predstavljajo kršitev mnogih pravic, ki pripadajo otrokom na mednarodni in nacionalni ravni. Temeljna definicija otroka je vsebovana v Konvenciji o otrokovih pravicah in mnogih drugih mednarodnih aktih. Nenazadnje podaja definicijo otroka tudi domača zakonodaja. Otroku tako na večih podlagah pripadajo tako človekove in otrokove pravice hkrati in se te ne izključujejo. Ena izmed pravic, katera pripada človeku je tudi pravica do sklenitve zakonske zveze. Posledično to pomeni, da tudi otroku pripada pravica do sklenitve zakonske zveze, vendar tukaj naletimo na težavo. Zakonska zveza otroka oz. mladoletne osebe načeloma ni dovoljena, saj prinese več škode kot koristi. V takšnih primerih pride do uporabe načela otrokove največje koristi, katero poskrbi, da se otrokom kot ranljivejši skupini zagotavljajo pravice v največji meri. Otroške poroke kršijo v največji meri načelo otrokove največje koristi, nadalje pa tudi pravico do izobraževanja, do zdravja, življenja, preživetja, do izražanja mnenja, do zaščite pred nasiljem, tudi spolnim, izkoriščanjem, trgovino z ljudmmi in seznam kršitev bi se lahko nadaljeval. Obstaja vedno več aktov, organizacij, tako vladnih kot nevladnih, kateri skušajo v največji meri preprečiti to škodljivo prakso, vendar kljub temu še vedno pojav teh na svetovni ravni ne upada v takšnem številu, kot bi si želeli.

Title:Child marriage as abuse of rights of the child
Abstract:Children's rights are currently facing significant challenges. Despite an increasing number of mesures to protect children and their rights, on the one hand obstacles keep emerging that push the realisation of the children's rights to margins. On the other hand there are obstacles that, despite our best efforts, we cannot completely eradicate. Child marriage is one such barrier. This harmful practice occurs all over the world, in both developed and less developed environments, because it is deeply rooted in traditional culture. Child marriage today constitute a violation of many rights belonging to children on both international and national levels. The fundamental definition of the child is contained in the Convention on the Rights of the Child and many other international instruments. Notably, the domestic law also provides a definition of the child.Thus, a child is entitled to both human rights and children's rights simultaneously, and these rights are not mutually exclusive. One of the rights inherent to humans is a right to marry. Consequently, this mean that the child has the right to marry, however, this is where we encounter a problem. Marriage of a child or a minor is generally not allowed as it brings more harm than benefits. In such cases, the principle of the best interest of the child is applied, ensuring that the rights of the children, as the most vunerable group, are upheld to the greatest extent possible. Child marriage most significantly violate the principle of the best interest of the child and further infringe upon the right to education, to life, to survival, to expression, to protection from violance, including sexual violance, exploitation, trafficking and the list of violations could go on and on. There are increasingly more laws, acts and organisantions, both govermental and non-govermental, that strive to prevent this harmful practice as much as possible. However, despite thus efforts, the occurrence of such practices on global scale has not decreased as suvh as desired.
