Title:Primerjalnopravna analiza ureditev sorojenca rešitelja : magistrsko delo

Abstract:Človeška življenja se s presaditvijo organov rešujejo že več kot pol stoletja, in sicer tako pri nesrečah kot tudi v primeru bolezni posledica katerih je odpoved organov. Najpogosteje so darovalci odrasli, vendar pa so to lahko tudi otroci. Za slednje se zahtevajo strožji pogoji darovanja, zaradi česar do te situacije pride predvsem v primerih dednih genetskih bolezni pri njihovih sorojencih, takšnega otroka pa terminologija imenuje »sorojenec rešitelj«. Skozi desetletja napredkov reproduktivne veje medicine je nastal še en specifičen tip sorojenca rešitelja- otrok, ki se rodi z namenom, da svojemu že obstoječemu bolnemu sorojencu reši življenje. Pri tem gre za obliko selektivne reprodukcije, saj je za dosego cilja, za katerega se takšen otrok rodi, potrebna genetska kompatibilnost, ker bolni sorojenec trpi za dedno genetsko boleznijo. Z razvojem postopka so se pričela pojavljati vprašanja o etičnosti takšnega načina reševanja življenj hudo bolnih otrok in vplivu na kloniranje na področju medicine. V ospredju pa se je znašla predvsem pravna regulacija varnosti sorojenca rešitelja in njegova nezmožnost privolitve v darovanje ter posledično rešitev življenja svojemu sorojencu, prav tako pa so se pričele diskusije o posegih v temeljne človekove pravice in svoboščine. V magistrski nalogi so predstavljeni pristopi držav do regulacije sorojencev rešiteljev, razvijajoča sodna praksa na tem področju ter primerjalno-pravna analiza različnih zakonodaj.

Title:Comparative legal analysis of legal frameworks on saviour sibling
Abstract:Human lives have been saved by organ transplantation for more than half a century, both in accidents and in the case of diseases resulting from organ failure. Most often, donors are adults, but they can also be children. Stricter donation conditions are required for the latter, as a result of which this situation occurs mainly in cases of hereditary genetic diseases in their siblings. In this case donor child is called a "saviour sibling" in the terminology. Through decades of advances in the reproductive branch of medicine, another specific type of saviour sibling has emerged - a child who is born with the intention of saving the life of his already existing sick sibling. This is a form of selective reproduction, since in order to achieve the goal for which such a child is born, genetic compatibility is necessary, because the sick sibling suffers from a hereditary genetic disease. With the development of the procedure, questions began to arise about the ethics of such a way of saving the lives of seriously ill children and the impact on cloning in the field of medicine. In the foreground, above all, was the legal regulation of the safety of the saviour sibling and his inability to consent to donation and, consequently, the saving of his sibling's life, and discussions also began about infringement of fundamental human rights and freedoms. The master's thesis presents the approaches of countries to regulation of saviour siblings, developing case law in this area and a comparative legal analysis of various legislations.
