Title:Opravljanje razgovorov z migranti v Schengenskem območju : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Republika Slovenija se kot članica Schengenskega območja, kot vsaka druga država, sooča s povečanim številom nedovoljenih migracij na tako imenovani balkanski poti. Pri tem se pojavlja težava doslednega izvajanja schengenske zakonodaje, zaradi česar je Evropska unija ustanovila različne aparate in pričela z izvajanjem ukrepov in načrtov z namenom preprečevanja nedovoljenih migracij in tihotapljenja migrantov. V Sloveniji se število nedovoljenih migracij povečuje od leta 2015 od tako imenovane migrantske krize naprej, pri čemer se slovenska policija sooča z vse večjim prihodom migrantov z Bližnjega vzhoda in afriške celine. Z vse večjim prihodom migrantov se povečuje tudi število kaznivih dejanj. Področje varnosti državne meje v Sloveniji, nedovoljenih migracij in tihotapljenje migrantov je ena izmed prioritetnih nalog slovenske policije, zaradi česar se je v slovenski policiji leta 2020 v sistematizacijo umestil profil strokovnjaka za opravljanje razgovorov z migranti, katerega poglavitna naloga je zbiranje operativnih podatkov od migrantov, ki so na nedovoljen način prestopili notranjo schengensko mejo, ter zbiranje informacij, pomembnih za identifikacijo in pregon storilcev kaznivih dejanj iz področja čezmejne kriminalitete ter ostalih kaznivih dejanj članov hudodelskih združb. V diplomskem delu smo naprej pojasnili teoretične pojme, pravno podlago za izvajanje razgovorov z migranti v schengenskem območju, predstavili politike EU za boj proti nedovoljenim migracijam, normativno pravno podlago delovanja strokovnjaka za opravljanje razgovorov ter predstavili in izpostavili težave, ki se pojavljajo pri razgovorih z migranti, ki so bili prijeti v okviru ilegalnega prehoda državne meje sami ali skupini, v prevoznih sredstvih, ali so jih člani hudodelske združbe prevažali v nehumanih razmerah.

Title:Debriefing activities with migrants in the Schengen area
Abstract:The Republic of Slovenia, as a member of the Schengen area, like every other country on the so-called Balkan route, faces an increased number of unauthorized migrations, with the problem of consistent implementation of Schengen legislation arising, as a result of which the European Union established various apparatuses and started implementing measures and plans with the aim of preventing unauthorized migration and preventing smuggling of migrants. In Slovenia, the number of illegal migrations has been increasing since 2015, since the so-called migrant crisis, with the Slovenian police facing an increasing influx of migrants from the Middle East and the African continent. With the increasing arrival of migrants, the number of crimes is also increasing. The area of national border security in Slovenia, illegal migration and smuggling of migrants is one of the priority tasks of the Slovenian police, which is why in 2020 the profile of an expert for conducting interviews with migrants was systematized in the Slovenian police, whose main task is to collect operational data from migrants, who illegally crossed the internal Schengen border, and the collection of information relevant to the identification and prosecution of perpetrators of crimes in the field of cross-border crime, as well as other crimes committed by members of criminal groups. In the thesis, we will further explain the theoretical concepts, the legal basis for conducting interviews with migrants in the Schengen area, present the EU policies for combating illegal migration, the normative legal basis for the work of an interviewing expert, and present and highlight the problems that arise in interviews with migrants who were caught illegally crossing the state border alone or in a group, in means of transport or were transported by members of a criminal group in inhumane conditions.
