Title:Dileme kazenskega varstva živali - nacionalni in mednarodni pogled : magistrsko delo

Abstract:V magistrskem delu je predstavljena ureditev kazenskopravnega varstva živali v Sloveniji, z osredotočanjem na novelo Stvarnopravnega zakonika (SPZ-B) iz leta 2020, ki je posredno vplivala tudi na zaščito živali v kazenskem pravu. Novela SPZ-B je z novim 15.a členom določila, da živali niso stvari, temveč čuteča živa bitja. Zakonodajalec pa je z novo vrednostno-pravno opredelitvijo živali, ki ima v stvarnem pravu le simbolični pomen, verjetno nenamerno poslabšal položaj živali v kazenskem pravu in zmanjšal njihovo kazenskopravno zaščito. Živali so bile v slovenskem kazenskem pravu namreč varovane na dva načina, in sicer kot stvari v okviru premoženjskih deliktov, hkrati pa so uživale status posebej zaščitenega objekta v okviru posebnih kaznivih dejanj po KZ-1. Po sprejemu nove definicije, ki živali ne obravnava več kot stvari, je kazenskopravna zaščita v okviru premoženjskih deliktov odpadla, posledično pa so živali v slovenskem kazenskem pravu zaščitene samo še na podlagi posebnih kaznivih dejanj, zlasti 341. člena KZ-1, ki določa kaznivo dejanje mučenja živali. Ker pa so določbe 341. člena KZ-1 pomanjkljivo opredeljene, ne nudijo zadostnega varstva v primerih, ko žival nekdo ukrade ali jo ubije, brez da bi se žival pri tem mučila. Ena izmed rešitev navedenega problema je zlasti v uporabi koncepta supremacije teleološke interpretacije, ki jo lahko uporabimo pri razlagi kazenskopravnih določb, vse dokler pravne praznine na področju varstva živali ne bodo zapolnjene s spremembami samega kazenskega zakonika.

Title:Dilemmas in criminal law protection of animals - a national and international overview
Abstract:This master's thesis presents the regulation of animal protection through criminal law in Slovenia, focusing on the amendment to the Law of Property Code (Stvarnopravni zakonik – SPZ-B) from 2020, which indirectly affected the protection of animals in criminal law. Through a new Article 15a, the amendment to the Law of Property Code established that animals are not property, but sentient living beings. However, by redefining the legal value of animals, which only carries a symbolic meaning in property law, the legislator may have unintentionally worsened the position of animals and reduced their protection in criminal law. In Slovenian criminal law, animals have previously been protected in two ways: as property in the context of property offences, and as a specially protected object in the context of specific offences under the Slovenian Criminal Code (Kazenski zakonik – KZ-1). Following the adoption of the new definition which no longer treats animals as property, the property offences under criminal law protection are no longer applicable. This consequently means that in Slovenian criminal law, animals are now solely protected under specific offences, in particular under Article 341 of the Criminal Code, which establishes the offence of animal cruelty. However, as the provisions of Article 341 of the Criminal Code are poorly defined, they consequently do not provide sufficient protection in cases where an animal is stolen or killed without explicit cruelty. One solution to this problem lies in using the concept of teleological interpretation of supremacy that can be applied to the interpretation of criminal law provisions until legal gaps in the field of animal protection are filled by amendments to the Criminal Code.
