Title:Otrok kot dokazno sredstvo v primerih spolne zlorabe : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu so bile opisane oblike spolnih zlorab in duševne posledice, ki jih le-te lahko povzročajo pri žrtvi. S pomočjo literature je bil opisan postopek obravnave kaznivega dejanja spolne zlorabe, katerega zakonska podlaga temelji na Zakonu o kazenskem postopku in prikazano, kaj v slovenskem predkazenskem in kazenskem postopku doživi otrok, žrtev spolne zlorabe. V postopku preiskave kaznivega dejanja otrok opravi več razgovorov, zdravniški pregled in nenazadnje, v sodnem postopku, tudi pričanje na sodišču. Diplomska naloga se osredotoča na otrokovo izjavo kot temelj preiskave. Opisano je, kolikokrat in komu otrok v preiskavi opiše dogodek, ki je bil zanj travmatičen, in kako le-to vpliva na njegovo duševno zdravje. S pomočjo tujih raziskav je bilo ugotovljeno, da je žrtvi spolne zlorabe najtežje dogodek (ali dogodke) večkrat opisovati in da je večkratno ponavljanje lahko razlog za duševne posledice. Opravljen je bil tudi kratek pregled implementacije hiše za otroke v nordijskih državah. Slovenska Hiša za otroke, ki v slovenski zakonodaji temelji na Zakonu o zaščiti otrok v kazenskem postopku in njihovi celostni obravnavi v hiši za otroke (ZZOKPOHO), črpa navdih ravno iz nordijskih držav, vendar je zaradi različnih zakonodaj pri nas implementirana drugače. Kljub vsemu je bilo ugotovljeno, da je od implementacije hiše za otroke dalje obravnava spolnih zlorab v slovenskem prostoru otroku vsekakor bolj prijazna, saj Hiša za otroke nudi celostno obravnavo otroka v kazenskem postopku, z vključeno psihoterapevtsko in psihosocialno podporo tako za žrtev kot za družino.

Title:The child as evidence in cases of sexual abuse
Abstract:Forms of sexual abuse and the mental consequences they can cause in the victim were described in the thesis. With the help of the literature, the procedure for dealing with the crime of sexual abuse was described, the legal basis of which is based on the Criminal Procedure Act, and what a child victim of sexual abuse experiences in the Slovenian pre-trial and criminal procedure. During the criminal investigation process, the child undergoes several interviews, a medical examination and, last but not least, in court proceedings, also testifying in court. The thesis focuses on the child's statement as the basis of the investigation. It is described how many times and to whom the child describes an event that was traumatic for him during the investigation, and how it affects his mental health. With the help of foreign research, it was established that it is most difficult for a victim of sexual abuse to repeatedly describe the event (or events) and that repeated repetition can be the reason for mental consequences. A brief review of the implementation of the children's house in the Nordic countries was also carried out. The Slovenian Children's Home, which in Slovenian legislation is based on the Act on the Protection of Children in Criminal Procedures and Their Comprehensive Treatment in Children's Homes (ZZOKPOHO), draws its inspiration from the Nordic countries, but is implemented differently in our country due to different legislation. Despite everything, it was found that since the implementation of the House for Children, the treatment of sexual abuse in Slovenia is definitely more child-friendly, as the House for Children offers comprehensive treatment of the child in criminal proceedings, including psychotherapeutic and psychosocial support for both the victim and the family.
