Title:Vpliv zakonodaje na varnost cestnega prometa : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Diplomsko delo proučuje številne aspekte sistemske spremembe zakonodaje na področju prometne varnosti cestnega prometa leta 2011. Poseben poudarek se nanaša na spremembe novele Kazenskega zakonika (KZ-1B, 2011), ki je kaznivo dejanje predrzne vožnje v cestnem prometu preimenovala v nevarno vožnjo v cestnem prometu, ki je kot blanketna norma zapisana v 324. členu Kazenskega zakonika (KZ-1B, 2011). Na podlagi pregleda sodne prakse ugotavljam, da bi morala slovenska zakonodaja določati ustrezen normativni okvir za razločevanje med prekrški in kaznivimi dejanji s področja cestnoprometnega prava ter med kaznivima dejanjema povzročitve prometne nesreče iz malomarnosti in nevarno vožnjo v cestnem prometu, ki v zakonu niso jasno opredeljeni. Na podlagi analize statističnih podatkov lahko opredelimo še nekaj drugih pomembnih zaključkov. Kljub splošnem trendu upadanja števila mrtvih v cestnem prometu od leta 2011, ko smo sprejeli novo prometno zakonodajo, smo še daleč od zastavljene vizije nič, kot tudi od zastavljenih strateških ciljev v nacionalnih programih za obdobji 2013-2022 in 2023-2030 (Javna agencija RS za varnost prometa, 2023). Statistični podatki števila umrlih in hudo poškodovanih pa kažejo tudi na dva pomembna trenda (starejši od 64 let in vozniki e-skirojev), ki jih mora cestna zakonodaja nadaljnjo nagovoriti.

Title:The impact of legislation on traffic road safety
Abstract:The thesis examines all aspects of systemic changes in legislation in the field of road traffic safety in 2011. Special emphasis is placed on the amendments to the Criminal Code (KZ-1B, 2011), which renamed the crime of reckless driving in road traffic to dangerous driving in road traffic, which is written as a blanket norm in Article 324 of the Criminal Code (KZ-1B, 2011). Based on the review of case law, I conclude that the Slovenian legislation should establish an appropriate normative framework for distinguishing between misdemeanors and criminal offenses in the field of road traffic law and between the criminal offenses of causing a traffic accident due to negligence and dangerous driving in road traffic, which are not clearly defined in the law. Based on the analysis of statistical data, we can define several other important conclusions. Despite the general downward trend in the number of road traffic deaths since 2011, when we adopted the new traffic legislation, we are still far from the set vision of zero, as well as from the set strategic goals in the national programs for the period 2013-2022 and 2023-2030 (Javna agencija RS za varnost prometa, 2023). The statistics on the number of deaths and serious injuries also point to two important trends (over 64 year-old and e-scooter drivers) that road legislation must further address.
