Title:Dilema prekrškovnega prava: plačilo polovične globe ali zasledovanje pravice? : plačilo polovične globe ali zasledovanje pravice?

Abstract:Veljavna prekrškovna zakonodaja v Republiki Sloveniji, natančneje 57.c člen Zakona o prekrških (ZP-1), za storilce prekrškov določa posebno ugodnost, če globo, torej kazen, izrečeno v prekrškovnem postopku, poravnajo v roku osmih dni po pravnomočnosti plačilnega naloga (ko je plačilo globe kršitelju naloženo s plačilnim nalogom) oziroma v roku osmih dni po izteku roka za napoved zahteve za sodno varstvo zoper odločbo o prekršku (ko je plačilo globe kršitelju naloženo z odločbo o prekršku). V tem roku namreč kršitelj lahko plača zgolj polovico izrečene globe. Ureditev originalno predstavlja težnjo k vzpodbuditvi plačilne discipline storilcev prekrškov, prek naknadnih novel zakona pa je zakonodajalec ureditev postopoma preoblikoval (še) v sredstvo namenjeno deflaciji zadev pred prvostopenjskimi sodišči. Storilec namreč možnosti polovičnega plačila v za to določenem roku nima, če v isti zadevi vloži tudi zahtevo za sodno varstvo. Slednja v prekrškovnem pravu predstavlja institut, ki hkrati naslavlja zagotovitev pravice do pritožbe in do sodnega varstva (torej sodne kontrole odločitev uprave). Ker se pravilo v praksi kaže kot problematično glede skladnosti z ustavno pravico do enakosti v zakonu (diskriminacija glede na gmotno stanje), je v nalogi ureditev preučena z vidika ustavnih pravic oziroma dopustnosti njihovega omejevanja, opravljena je analiza sistemske umestitve in pozitivnopravne ureditve prekrškovnega prava, s poudarkom na hitrem postopku prekrškovnega organa. Preučena so vsa pripravljalna gradiva zakonodajalca, ki so se nanašala na spremembe zadevnega pravila, ter opravljena primerjava z institutom pogajanj o priznanju krivde iz kazenskega prava. Na koncu naloge je raziskano še vprašanje dostopa do Ustavnega sodišča Republike Slovenije v prekrškovnih zadevah oziroma konkretno glede dostopa v primeru neustavnosti 57.c člena Zakona o prekrških (ZP-1).

Title:A misdemeanour law dilemma:to pay half of the fine or to chase justice? : to pay half of the fine or to chase justice?
Abstract:The applicable misdemeanor legislation in the Republic of Slovenia, specifically Article 57.c of the Zakon o prekrških (ZP-1), provides a special benefit for offenders if they settle the fine, within eight days after the finality of the payment order (when a fine is ordered by a payment order) or within eight days after the expiration of the deadline for announcing a request for judicial protection against a misdemeanor decision (when a fine is ordered by a misdemeanor decision). During this period, the violator can only pay half of the imposed fine. The regulation originally represents a tendency to encourage the payment discipline of offenders, but through subsequent amendments to the law, the legislator gradually transformed the regulation (further) into a tool intended for the deflation of cases before first-instance courts. Namely, the offender does not have the option of half payment, if he also files a request for judicial protection in the same case. In misdemeanor law, the latter represents an institute that simultaneously addresses the provision of the right to appeal and to judicial protection (that is, judicial review of administrative decisions). Since the rule in practice appears to be problematic in terms of compliance with the constitutional right to equality in law (discrimination based on financial status), the regulation is examined from the point of view of constitutional rights or the admissibility of their restriction, an analysis of the systemic placement and positive legal regulation of misdemeanor law is also carried out, with an emphasis on the fast procedure of the misdemeanor authority. All the preparatory materials of the legislator, which referred to changes to the relevant rule, were examined, and a comparison was made with the institute of plea bargaining in criminal law. At the end of the assignment, the issue of access to the Constitutional Court of the Republic of Slovenia in misdemeanor cases, or specifically regarding access in case of unconstitutionality of Article 57c of the Zakon o prekrških (ZP-1), is investigated.
