Title:Problematika pranja denarja v 21. stoletju : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Pranje denarja je proces, pri katerem kriminalci želijo svoj nezakonito pridobljen dobiček prikazati kot zakonito pridobljena sredstva. Proces poteka v različnih fazah, katerih cilj je, da se denar brez sumljivih sledi umesti nazaj v zakoniti finančni sistem. Kriminalec ustvari navidezno zakoniti izvor bogastva, njegov resnični izvor pa je zakrit finančnim institucijam ter organom pregona. Da bi svoj »umazan« dobiček »oprali«, se kriminalci poslužujejo različnih metod: tihotapljenje velikih zneskov, kupovanje nepremičnin, ustanavljanje navideznih podjetij, igre na srečo, ipd. Pranje denarja predstavlja velik globalni problem, saj vpliva na gospodarstva ter finančne sisteme po vsem svetu. Velike olajševalne okoliščine pri globalizaciji problematike lahko pripišemo razširitvi trgovanj podjetij iz nacionalnih na svetovne trge ter velikemu napredku v tehnologiji, ki je kriminalcem omogočila, da so razvili nove načine, ki jim omogočajo, da svoj umazan denar operejo hitreje, lažje ter zakrijejo vse sledi o njegovem izvoru. Podjetja in organizacije po celem svetu sprejemajo ukrepe proti pranju denarja z namenom preprečevanja finančnih izgub, izpolnjevanja zakonskih obveznosti ter zaščite svojega ugleda. S sprejetjem ukrepov podjetja tako tudi sodelujejo pri preprečevanju in odkrivanju finančne kriminalitete ter ohranjajo zaupanje svojih strank ter partnerjev. Z namenom preprečevanja pranja denarja so po celem svetu, tako na državnih kot mednarodnih ravneh, ustanovljene institucije in organizacije, kot so Skupina Egmont, FATF, Europol in Interpol, ki delujejo kot platforma za izmenjavo podatkov in informacij, s čimer je omogočeno hitrejše odkrivanje ter prepoznavanje sumljivih transakcij in vzorcev. Glavni cilj teh organizacij je skupno medsebojno sodelovanje, saj tako ustvarijo močna partnerstva za boj proti problematiki finančne kriminalitete. Organizacije, ki se borijo proti problematiki pranja denarja, nenehno razvijajo nove tehnike in strategije ter si prizadevajo biti vedno korak pred kriminalnimi združbami. Eden izmed najpomembnejših dejavnikov pri boju proti problematiki je močno mednarodno sodelovanje, ki je bistveno pri izmenjavi pomembnih podatkov, informacij ter dokumentov, ki so ključni za odkrivanje pranja denarja.

Title:The issue of money laundering in the 21st century
Abstract:Money laundering is the process by which criminals seek to pass off their illegal gains as legitimate assets. The process is carried out in different stages, to place the money back into the legal financial system without any suspicious traces, thus creating the appearance of a legal source of wealth for the criminal, whose actual origin is hidden from financial institutions and law enforcement authorities. To "launder" their "dirty" profits, criminals use a variety of methods including, but not limited to, large-scale smuggling, real estate purchases, shell companies, gambling, etc. Money laundering is a major global problem, affecting economies and financial systems worldwide. The major facilitating factors in the globalisation of the problem can be attributed to the expansion of business trading from national to global markets, and to significant advances in technology which have enabled criminals to develop new ways of laundering their dirty money faster, easier and by hiding all traces of its origin. Businesses and organisations worldwide are taking action against money laundering to prevent financial losses, comply with legal obligations and protect their reputation. By taking measures, companies also help to prevent and detect financial crime and maintain the trust of their customers and partners. To prevent money laundering, institutions and organisations such as the Egmont Group, FATF, Europol and Interpol have been set up around the world, both at national and international levels, to act as a platform for the exchange of data and information, allowing for faster detection and identification of suspicious transactions and patterns. The main objective of these organisations is to work together, to create strong partnerships to combat the problem of financial crime. Organisations fighting money laundering are constantly developing new techniques and strategies and striving to stay one step ahead of criminal gangs. One of the most critical factors in the fight against money laundering is strong international cooperation, which is essential in exchanging relevant data, information and documents that are key to detecting money laundering.
