Title:Analiza sodne prakse policijskega zbiranja obvestil : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Slovenska ureditev policijskega zbiranja obvestil lahko zaradi svoje specifičnosti in razdeljenosti povzroči težave v poteku predkazenskega in kazenskega postopka. S problematiko zbiranja obvestil so se avtorji ukvarjali že od samega začetka sprejemanja novega Zakona o kazenskem postopku (ZKP) po osamosvojitvi. Od leta 1994, ko je bil sprejet ZKP, pa do danes je bilo narejenih veliko sprememb, in sicer tudi na področju zbiranja obvestil. Izvedli smo pregled, kako so te spremembe vplivale na obravnavano tematiko. Začeli smo teoretičnim pregledom relevantne zakonodaje s področja kazenskega prava ter tudi policijskega prava, nadaljevali pa s pregledom in analizo sodne prakse s področja zbiranja obvestil po 148. členu ZKP. Celovito smo zajeli problematiko zbiranja obvestil po obstoječi zakonodaji. Opredelili smo nekatera izstopajoča področja, ki se v sodni praksi pojavljajo v povezavi z zbiranjem obvestil. Iz dostopne literature je razvidno, da nekatere težave v povezavi z zbiranjem obvestil še zmeraj obstajajo. Pojavljajo se predvsem glede usode uradnih zaznamkov, o njihovem izločanju iz sodnih spisov, kot tudi definicije obvestila, zbranega po 148. členu ZKP ter sam postopek zbiranja obvestil, ki ga zakon izrecno ne opredeljuje. Veliko sodne prakse je zaznati na področju zbiranja obvestil od osumljenca, le-to se od zbiranja obvestil od oseb, ki niso osumljene, razlikuje. Določitev trenutka, ki označuje, da je neka oseba postala osumljenec in je potrebno takšno osebo seznaniti z njegovimi pravicami, namreč ni zmeraj jasna.

Title:Analysis of the case - law of police gathering of information
Abstract:Due to its specific and fragmented nature, the Slovenian process for police gathering of information may cause problems in the course of pre-trial and criminal proceedings. The authors have been dealing with the issue of information gathering since the very beginning of the adoption of the new Criminal Procedure Act (CPA) after the independence. Since 1994, when the Criminal Procedure Act was adopted, many changes have been made, including in the area of information gathering. We have carried out a review of how these changes have affected the subject under discussion. Starting with a theoretical overview of the relevant legislation in the field of criminal law and police law, and through a review and analysis of the case law in the field of the gathering of information under Article 148 of the CPA, we have comprehensively covered the issue of the gathering of information under the existing legislation. In this way, we have identified some of the areas that arise in case law in relation to the gathering of information. The available literature shows that some problems still exist in relation to the gathering of information, especially with regard to the fate of official documents made in the process by the police, whether or not they are to be excluded from court files, as well as the definition of gathering of information under Article 148 of the CPA and the procedure for collecting information itself, which is not explicitly defined by the law. Case – law contains numerous cases in the area of the gathering of information from a suspect, which differs from the normal gathering of information. The definition of the moment at which a person becomes a suspect and must be informed of his rights is not always clear.
