Abstract:Pravica do zdravstvenega varstva, ki predstavlja eno izmed najpomembnejših področij socialne varnosti, je ustavno varovana kategorija človekovih pravic in temeljnih svoboščin, saj sta zdravje in življenje nenadomestljivi dobrini, zato se mora, ne glede na osebne okoliščine in družbeni položaj posameznika le ta zagotavljati vsakomur, ob čimer imigranti ne predstavljajo nobene izjeme.

Title:Immigrants healthcare
Abstract:The right to healthcare, which represents one of the most important areas of social security, is a constitutionally protected category of human rights and fundamental freedoms, as health and life are irreplaceable goods. Therefore, healthcare must be provided to everyone regardless of personal circumstances and social status, with immigrants being no exception. In Slovenia, equality before the law is guaranteed at the constitutional level, meaning that human rights and fundamental freedoms must be ensured for all individuals, including immigrants, as emphasized by international legal instruments. Immigrants often face various barriers in accessing healthcare rights, which primarily depend on their legal status. This status determines their inclusion in mandatory health insurance, which provides a wide range of healthcare services. Those without a regulated status are entitled only to emergency medical assistance. They encounter numerous challenges, with the most common being linguistic, cultural, economic, and institutional barriers. These significantly affect their ability to obtain adequate healthcare, with special attention given to vulnerable groups such as children, women, the disabled, and the elderly. Due to the stress of migration, war trauma, violence and torture before departure, conditions during travel, living conditions, length of stay, linguistic and cultural differences, and ultimately their legal status and consequent access to healthcare services, immigrants are often "targets" of infectious diseases, mental health issues, and chronic illnesses. To avoid violating the principles of equality and non-discrimination, it is the duty of the state to ensure respect for the dignity of immigrants and not to subject them to more suffering than necessary to resolve their legal status. Access to healthcare for immigrants in Europe is often limited at the formal legal level, as they are not granted the same rights as the domestic population. Where formal opportunities and rights for migrants exist on paper, access to them in practice is hindered. Slovenia is obliged to provide immigrants with adequate, quality, and safe healthcare, even if this means adapting healthcare needs, especially for vulnerable groups of immigrants.
