Title:Prekrški po Zakonu o zasebnem varovanju : magistrsko delo

Abstract:Prekršek je dejanje, ki pomeni kršitev zakona, uredbe Vlade Republike Slovenije ali odloka samoupravne lokalne skupnosti. Zakon o prekrških (»ZP-1«, 2011) določa splošne pogoje za predpisovanje prekrškov in sankcij zanje, splošne pogoje za odgovornost za prekrške, za izrekanje in za izvršitev sankcij za prekrške, postopek za prekrške ter organe in sodišča za odločanje o prekrških (»ZP-1«, 2011, čl. 1). V primeru storjenega prekrška pristojni organ lahko odloča o prekršku s plačilnim nalogom, prekrškovno odločbo ali opozorilom. Postopek pa lahko tudi ustavi z uradnim zaznamkom. V primeru ugotovljenih kršitev med inšpekcijskimi nadzori lahko Inšpektorat za notranje zadeve Republike Slovenije sproži prekrškovni postopek. Enak postopek pa se lahko izpelje tudi, kadar je za tak postopek pristojno Ministrstvo za notranje zadeve kot prekrškovni organ, vendar za izvedbo tega postopka ni pristojna policija (Inšpektorat RS za notranje zadeve, 2020). Splošna načela inšpekcijskega nadzora ureja Zakon o inšpekcijskem nadzoru (»ZIN«, 2007). Izvršujejo ga inšpektorji kot uradne osebe s posebnimi pooblastili in odgovornostmi. Inšpektorat opravlja naloge prekrškovnega organa, kadar ugotovi kršitve določil posameznih veljavnih zakonov, med drugim tudi Zakona o zasebnem varovanju. Zakon o zasebnem varovanju (»ZZasV-1«, 2011) ureja področje zasebnega varovanja, pri čemer opredeljuje različne oblike varovanja, pristojnosti in pogoje za njegovo izvajanje. Prav tako določa ukrepe in dolžnosti varnostnikov ter pogoje za izvajanje zasebnega varovanja tujih oseb. Poleg tega zakon nalaga obvezno organizacijo varovanja, predpisuje dolžnosti zavezancev in vodenje evidenc, ureja nadzor nad izvajanjem varovanja ter določa kazenske sankcije za kršitve predpisov (»ZZasV-1«, 2011, čl. 1).

Title:Minor offenses under the private security act
Abstract:Minor offenses are actions that violate a legislative act, a government regulation of the Republic of Slovenia or a decree of an autonomous local territorial entity. The Minor Offense Act (»ZP-1«, 2011) specifies general conditions for determining minor offenses and imposing sanctions for them, the liability for minor offenses, imposing and enforcing sanctions for minor offenses, minor offense proceedings as well as authorities and courts that rule on minor offenses (»ZP-1«, 2011, Art. 1). In the event of a minor offense, the competent authority may impose a payment order, issue a minor offense decision or give a warning. The proceedings may also be suspended by a formal endorsement. When minor offenses are determined during inspections, the Internal Affairs Inspectorate of the Republic of Slovenia may initiate minor offense proceedings. The same proceedings may be initiated when the ministry of internal affairs, not the police, is competent for such proceedings in the role of a minor offense authority (Internal Affairs Inspectorate of the Republic of Slovenia, 2020). General inspection principles are regulated in the Inspection Act (»ZIN«, 2007). They are enforced by inspectors as official persons with specific powers and responsibilities. The Inspectorate performs tasks of a minor offense authority when it determines minor offenses of provisions of individual legislative acts in force, including the Private Security Act. The Private Security Act (»ZZasV-1«, 2011) specifies private security, forms of security, powers, conditions for ensuring private security, measures and duties of a security guard, conditions for ensuring private security of foreign persons, mandatory organisation of security and duties of subjects, supervision, records and criminal provisions in the field of security (»ZZasV-1«, 2011, Art. 1).
