Title:Delovnopravno in socialnopravno varstvo invalidov s statusom po ZPIZ-2 : magistrsko delo

Abstract:Magistrska naloga obravnava problematiko varstva pravic invalidov, ki so pridobili status na podlagi ZPIZ-2. Gre za t.i. delovne invalide. Delovni invalidi se srečujejo s številnimi ovirami, med drugim tudi v delovnem okolju. S ciljem, da se jim zagotovi enakovreden položaj, je bila sprejeta vrsta mednarodnih ter nacionalnih predpisov. V Sloveniji na področje varstva pravic invalidov posegajo številni predpisi, ki se med seboj tudi prepletajo. V prvi vrsti so pomembni predvsem ZPIZ-2, ZDR-1 ter ZZRZI, s pomočjo katerih se delovnim invalidom zagotavlja varstvo tako na področju socialne varnosti kot tudi v delovnem razmerju. ZPIZ-2 določa pravice iz invalidskega zavarovanja, ki je del obveznega socialnega zavarovanja in s tem tvori sistem socialne varnosti. Delovni invalidi II. oziroma III. kategorije invalidnosti lahko pridobijo pravico do poklicne rehabilitacije, pravico do premestitve, pravico do dela s krajšim delovnim časom ter pravico do denarnega nadomestila. Praviloma je dolžnost delodajalca, da te pravice tudi zagotovi. Delovnim invalidom se zagotavlja tudi posebno delovnopravno varstvo, in sicer v okviru zaposlovanja, usposabljanja ter preusposabljanja. Prav tako so delovni invalidi upravičeni do posebnega varstva pred odpovedjo pogodbe o zaposlitvi. Odpoved je možna le po vnaprej določenem postopku, znotraj katerega ima pomembno vlogo Komisija za ugotovitev podlage za odpoved pogodbe o zaposlitvi, ki poda mnenje glede odpovedi. V ZDR-1 obstajajo tudi številne druge določbe, ki zagotavljajo varstvo vsem kategorijam invalidov, ne le delovnim invalidom. V primeru, ko je delovnemu invalidu odpovedana pogodba o zaposlitvi, obstajajo instituti v okviru ZZRZI, ki invalidom zagotavljajo varstvo. Kvotni sistem zaposlovanja invalidov delodajalce zavezuje, da zaposlujejo določeno število invalidov. V kolikor invalid ni zmožen opravljati dela v običajnem delovnem okolju, pa se zagotavljajo različne oblike zaposlovanja, kot je zaposlitev v podporni ali zaščitni zaposlitvi ali v invalidskem podjetju.

Title:Labor law and social law protection of disabled persons with status according to ZPIZ-2
Abstract:The master's thesis addresses the protection of the rights of disabled persons with status according to ZPIZ-2 - so-called persons with work disabilities. Persons with disabilities face many obstacles, including the obstacles in the work environment. Several international and national documents have been adopted to ensure them an equal position. In Slovenia, the protection of the rights of persons with disabilities is affected by numerous regulations that are also intertwined. The most important are ZPIZ-2, ZDR-1 and ZZRZI, which provide protection to persons with disabilities in the field of social security as well as in employment. ZPIZ-2 determines the rights arising from disability insurance, which is part of compulsory social insurance and forms the social security system. Disabled persons with disabilities of the second or third category of disability may acquire the right to vocational rehabilitation, the right to relocation, the right to part-time work and the right to financial compensation. As a rule, the employer must ensure these rights. Disabled people are also provided with special labour protection. This is in the context of recruitment, training and retraining. Likewise, people with disabilities are entitled to special protection against dismissal. Dismissal is possible only when following a pre-defined procedure, within which the Commission plays an essential role in determining the grounds for dismissal, and gives an opinion on the dismissal. In addition, several other provisions of ZDR-1 protect all categories of disabled persons, not only persons with work disability. Even if the employment contract of a disabled person is terminated, certain institutes within the ZZRZI provide protection. The quota system for the employment of persons with disabilities obliges employers to employ a certain number of persons with disabilities. If a disabled person is unable to perform work in a normal working environment, various forms of employment are provided, such as employment in supportive or protective employment or in a disability company.
