Title:Nezakonit ribolov v Sloveniji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Diplomsko delo predstavlja pregled pojavnih oblik nezakonitega ribolova, zakonodajo, ki te znake podrobno opredeljuje ter ribiške čuvaje, ki kršitve v praksi ugotavljajo. Glavni cilj diplomske naloge je ugotoviti, kakšno je dejansko stanje glede nezakonitega ribolova v Sloveniji – kateri prekrški so najpogostejši, koliko jih je ter kakšne kazni kršitelje doletijo. Ugotovitve, naše študije kažejo, da se največ prekrškov navezuje na samo ribo, kar pomeni tatvine rib, uplena več rib kot je dovoljeno, prekoračitev uplena; poleg prekrškov povezanih s samo ribo, pa se pojavlja tudi lov brez ribolovne dovolilnice in ribolov z nedovoljeno opremo. Ugotovitve so pokazale, da imamo v Sloveniji v zadnjih 5. letih le 3 kazniva dejanja, povezana z nezakonitim ribolovom, število kršitev pa se giblje nekje od 30 do 50 prekrškov na ribiško družino (v Sloveniji je 64 ribiških družin), kar pomeni letno približno 2500 prekrškov, povezanih z ribolovom, a so intervjuvanci povedali, da število kršitev iz leta v leto počasi pada. Kazni, ki doletijo kršitelje se razlikujejo glede na povzročen prekršek. V primeru, ko je prekršek blažje narave, se ribiški čuvaji odločajo za izrek opozorila. Kadar gre za hujši prekršek, na primer uplen večih rib (in so te že mrtve), ali storitve več prekrškov na enkrat, kot je na primer lovljenje rib pod mersko dolžino, nedovoljena vaba in nedovoljena tehnika – takšne kršitelje doleti denarna kazen, za vsak prekršek posebej, kar pomeni, da se kazni seštejejo. Denarne kazni se začnejo pri 250 € in lahko segajo vse do 1500 €. Takšne kazni izreče ribiški inšpektor, katerega je ob kršenju potrebno obvestiti. Poleg teh dveh najpogosteje izrečenih kazni se ribiški čuvaji poslužujejo tudi odvzema dnevne ali letne ribolovne dovolilnice ali zapustitve ribolovnega območja. Povzamemo lahko, da je v Sloveniji to področje kar dobro urejeno tako v zakonodaji kot tudi v sami praksi in za zdaj ne povzroča resnejše problematike.

Title:Illegal fishing in Slovenia
Abstract:The diploma thesis presents the theoretical signs of illegal fishing, the legislation that defines these signs in detail, and the fishing guards who identify violations in practice. Main goal of this thesis is to find out what actual situation is regarding illegal fishing in Slovenia – which offenses are the most common and how many there are, and what punishments the offenders receive. Findings obtained through interviews with fishing guards show that most offenses are related to the fish itself, which means stealing fish, taking more fish than it's allowed, exceeding the limit; in addition to offenses related to the fish itself, there is also hunting without a fishing permit and fishing with unauthorized equipment. The findings revealed that in the last 5 years in Slovenia, we had only 3 criminal acts related to illegal fishing, and in terms of violations, the number ranges from 30 to 50 offenses per fishing family (there are 64 fishing families in Slovenia), which means approximately 2.500 violations related to fishing, but the interviewees said that the number of violations is slowly decreasing from year to year. Penalties for offenders vary depending on the offense committed. In the case when the offense is of a milder nature, the fishing guards decide to issue a warning. When it is more serious offense, for example, taking several fish (and they are already dead) or committing several offenses at once, such as catching fish under legal length, using illegal bait and illegal technique – such offenses are fined for each offence, which means that the penalties are cumulative. Fines start at 250 € and can go up to 1.500 €. These kinds of penalties are imposed by the fishing inspector, who must be notified in the event of a violation. In addition to these two most frequently imposed punishments, fishing guards also like to incline to confiscation of daily or annual fishing permits or leaving the fishing area. With the findings obtained through interviews, we have concluded that in Slovenia this area is quite well regulated, both in legislation and in practice itself, and for now it doesn't cause any serious problems.
