Title:Upravljanje in regulacija podatkov v pravu EU: analiza Akta o podatkih : magistrsko delo

Abstract:Razvoj digitalnih tehnologij ima odločilen vpliv na razvoj družbe in prava. Pomen podatkov se je z uvedbo interneta stvari, velikih podatkov, umetne inteligence in drugih naprednih tehnologij, še znatno povečal. Vse boljši sistemi za upravljanje in analizo so podatkom dodali ogromno ekonomsko in družbeno vrednost. Internet stvari pri tem igra pomembno vlogo, saj omogoča povezljivost digitalnih naprav preko senzorjev, kar ustvarja spet nove količine podatkov. Mnoge svetovne velesile so prepoznale potencial digitalnih tehnologij in podatkov ter ga s pridom izkoriščajo. Tega potenciala se zaveda tudi EU, ki pospešuje digitalizacijo, saj jo prepoznava kot odločilno pri ustvarjanju novih priložnosti za inovacije, gospodarsko rast in ohranjanje konkurenčnosti na svetovnem trgu. Akt o podatkih je del širše regulativne ureditve, ki ga je EU zasnovala za doseganje ciljev, kot so krepitev podatkovnega gospodarstva, digitalizacije in sistemov umetne inteligence, z namenom vzpostavitve digitalne suverenosti. Akt o podatkih je bil sprejet z namenom krepitve notranjega trga s podatki, saj želi spodbuditi več podatkov za inovacije in konkurenco. Vzpostavlja bolj pošten način delitve podatkov, ki nastajajo z uporabo naprav interneta stvari in določa nove pravice do dostopa in deljenja podatkov za uporabnike teh naprav. Hkrati vzpostavlja pravni okvir za sklepanje novih pogodb med imetniki podatkov in uporabniki, kar slednjim omogoča pravičen dostop do podatkov. Obseg Akta o podatkih ureja tako osebne kot neosebne podatke. V magistrskem delu ugotavljam, da je bilo upravljanje podatkov zaradi pomanjkljive zakonodaje na določenih področjih oteženo. Zaradi številnih izzivov se evropsko pravo o podatkih nenehno širi in razvija. Akt o podatkih in drugi regulatorni predpisi predstavljajo pomemben prispevek k boljšemu upravljanju s podatki. Vzpostavljen je bil nov sistem, ki prispeva k bolj pošteni delitvi podatkov med deležniki. Kljub temu obstajajo pomisleki o tem, kako učinkovito bodo novi mehanizmi lahko pripomogli k uresničitvi vseh začrtanih ciljev. Magistrsko delo obravnava vlogo podatkov in interneta stvari v sodobni družbi, razvoj upravljanja podatkov v EU ter se osredotoča na nekatere ključne vidike Akta o podatkih.

Title:Governance and Regulation of Data in EU Law: An Analysis of the Data Act
Abstract:The development of digital technologies is having a significant and transformative impact on the evolution of society and the law. The significance of data has markedly increased with the introduction of the Internet of Things, big data, artificial intelligence and other sophisticated technologies. The continual enhancement of management and analytical systems has resulted in the substantial economic and societal value addition of data. The Internet of Things plays a significant role in this process by enabling digital devices to be connected via sensors, which in turn generates new data sets. A significant number of the world's leading powers have identified the potential of digital technologies and data and are exploiting it. The European Union is similarly aware of this potential and is accelerating the process of digitisation, recognising it as crucial in creating new opportunities for innovation, economic growth and maintaining competitiveness in the global market. The Data Act is part of a broader regulatory regime designed by the EU to achieve objectives such as strengthening the data economy, digitisation and artificial intelligence systems, with a view to establishing digital sovereignty. The Data Act was adopted with the objective of reinforcing the internal market in data, with the intention of stimulating the generation of data for the purposes of innovation and competition. The Data Act establishes a fairer method of sharing data generated by Internet of Things devices. It establishes new data access and sharing rights for users of IoT devices. Additionally, it establishes a legal framework for new contracts between data holders and users, allowing the latter to have fair access to data. The scope of the Data Act extends to both personal and non-personal data. In my master's thesis, I conclude that the lack of legislative measures has constrained the development of effective data governance frameworks in specific domains. Due to the presence of numerous challenges, European data law is in a state of continual expansion and evolution. The Data Act and other regulatory provisions represent a significant contribution to the advancement of data governance. A novel system has been implemented with the objective of facilitating a more equitable distribution of data among stakeholders. Concurrently, there are concerns regarding the extent to which the novel mechanisms will be capable of contributing to the fulfilment of the established objectives. The master's thesis examines the role of data and the Internet of Things in modern society, the evolution of data governance in the EU, and focuses on some key aspects of the Data Act.
