Title:Kršitev standarda dobrega strokovnjaka kot podlaga za odškodninsko odgovornost zdravnika : magistrsko delo

Abstract:Standard dobrega strokovnjaka, poleg zaposlenih, je eden od osnovnih stebrov zdravstvenega sistema. Spoštovanje standardov je pogosto znak uspešnega kolektiva, ki se odraža v uspešnem zdravljenju pacientov. Standard dobrega strokovnega (profesionalni standard) je namreč osrednja stvar pri določanju odgovornosti za nastalo škodo. Igra ključno vlogo, saj kršitve tega standarda pripeljejo do vprašanja odgovornosti. Če zdravstveni delavec ne deluje po priznanih standardih, bi to povzročilo nastanek škode in govorimo o delovanju contra legem artis (nedopustno škodljivo dejanje). Zdravstveni delavec lahko krši ta standard v kateri koli fazi zdravljenja. Kršitev standarda se lahko pojavi, če je nepravilno izpolnil pojasnilno dolžnost, ni prejel pacientovega dovoljenja za zdravljenje, saj je mislil, da se posledice ne bodo pojavile, ni ravnal s potrebno skrbnostjo, zaradi česar je nastala pacientu škoda, itn. Odnos med pacientom in zdravnikom temelji na pogodbi (pogodba o zdravstvenih storitvah), ki opredeljuje pravice in obveznosti. Kršitev standarda prav tako pomeni le kršitev te pogodbe. Odgovornost, ki izhaja iz kršitev tega standarda, je lahko civilna in kazenska. V tej nalogi smo se omejili na civilno odgovornost (oziroma kršitev pogodbene obveznosti). Poleg tega je treba upoštevati, da ima pacient poleg pravic, tudi dolžnosti (pacient je lahko tudi soodgovoren za poslabšanje zdravja, če ni upošteval priporočil zdravnika). Z določitvijo odgovornosti zdravnika za škodo (ko so izpolnjeni vsi pogoji) pacient pridobi pravico do odškodnine. Pacient je upravičen do odškodnine za nepremoženjsko in premoženjsko škodo. Znesek te odškodnine ni nikjer natančno določen.

Title:Breach of the standard of good professional conduct as a basis for a physician´s liability for damages
Abstract:The standard of a good professional conduct, in addition to employees, is one of the basic pillars of the health care system. Adherence to standards is often a sign of a successful team, which is reflected in the successful treatment of patients. The standard of a good professional conduct (professional standard) is the central thing in determining liability for damage. It plays a crucial role, as violations of this standard give rise to a condition of liability. If a healthcare professional does not act according to recognized standards, this would result in damage and we are talking about acting contra legem artis (an inadmissible harmful act). A healthcare professional may violate this standard at any stage of treatment. Violation of the standard can occur if he improperly fulfilled the duty of explanation, did not receive the patient's consensus for treatment, slightly believed that the consequences would not occur, did not act with due diligence, so he did harm, thereby worsening the patient's health, and so on. The relationship between the patient and the doctor is based on a contract (health services contract), which defines rights and obligations. A breach of the standard also constitutes a breach of this contract. Liability arising from violations of this standard may be civil and criminal. In this thesis, we have limited ourselves to civil liability (or breach of contractual obligations). In addition, it should be borne in mind that in addition to the doctor, the patient also has rights, but also obligations (the patient may also be co-responsible for the deterioration of health if he did not follow the doctor's recommendations). By determining the liability of the doctor for the damage (when all conditions are met), the patient acquires the right to compensation. The patient is entitled to compensation for immaterial and material damage. The amount of this compensation is not specified anywhere.
