Title:Analiza uporabe prisilnih sredstev v postopkih Mestnega redarstva Ljubljana : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Raziskave so pokazale, da je potrebno, da so represivni organi, vključno s policijo in redarstvom, ustrezno usposobljeni za pravilno in sorazmerno uporabo prisilnih sredstev. Zakonodaja je natančno opredelila, kdaj in kako se ta sredstva smejo uporabljati, da bi se preprečile zlorabe in zagotovile pravice posameznikov. Uporaba prisilnih sredstev v okviru zakonitih pooblastil je opredeljena kot nujna, a vendar občutljiva tema, ki zahteva natančno regulacijo zaradi možnosti poseganja v temeljne človekove pravice. Poudarjeno je bilo, da mora biti uporaba teh sredstev pravno urejena in skladna z načeli zakonitosti in sorazmernosti. Dovoljeno je bilo, da se prisilna sredstva uporabljajo le v omejenih okoliščinah, kjer druge metode niso učinkovite, pri čemer je bila vsaka uporaba vezana na spoštovanje človekovih pravic. Raziskave so pokazale, da morajo biti represivni organi, vključno s policijo in redarstvom, ustrezno usposobljeni za pravilno in sorazmerno uporabo prisilnih sredstev. Zakonodaja je natančno opredelila, kdaj in kako se ta sredstva smejo uporabljati, da se preprečijo zlorabe in zagotovijo pravice posameznikov. V diplomskem delu je bila preučena uporaba prisilnih sredstev v mestnem okolju, pri čemer je bilo ugotovljeno, kako so ta sredstva uporabljena s strani redarjev. Poudarjeno je bilo, da mora biti ravnovesje med zagotavljanjem varnosti in zaščito temeljnih svoboščin ohranjeno, pri čemer je bilo delovanje usklajeno z zakonodajo in etičnimi standardi. V raziskavi je bila analizirana zakonitost in etičnost uporabe prisilnih sredstev, z osredotočenostjo na usposobljenost redarjev in preventivno vlogo teh sredstev. Vključena je bila statistična analiza uporabe teh sredstev, ob preučitvi primerov iz Mestnega redarstva Ljubljana. Ugotovljeno je bilo, da je pravilna in sorazmerna uporaba ključnega pomena za ohranjanje zaupanja javnosti in učinkovitost delovanja redarstva.

Title:Analysis of the use of coercive measures in the proceedings of the Ljubljana municipal wardens
Abstract:Research has shown that repressive authorities, including the police and the police, need to be properly trained in the correct and proportionate use of coercive means. Legislation has defined precisely when and how these means may be used in order to prevent abuses and safeguard the rights of individuals. The use of coercive means within the scope of legitimate powers is identified as a necessary but sensitive subject that requires careful regulation because of the potential for interference with fundamental human rights. It was stressed that the use of these means must be regulated by law and comply with the principles of legality and proportionality. It was permissible to use coercive means only in limited circumstances where other methods were not effective, any use being subject to respect for human rights. Research has shown that repressive authorities, including the police and the police, must be properly trained in the correct and proportionate use of coercive measures. Legislation has defined precisely when and how these means may be used in order to prevent abuses and guarantee the rights of individuals. The thesis examined the use of coercive means in the urban environment, identifying how these means are used by police officers. It was stressed that a balance between ensuring security and protecting fundamental freedoms had to be maintained, with actions being in line with the law and ethical standards. The study analysed the legality and ethics of the use of coercive means, focusing on the competence of the police officers and the preventive role of these means. A statistical analysis of the use of these means was included, examining cases from the Ljubljana City Police. It was concluded that the correct and proportionate use is crucial for maintaining public confidence and the effectiveness of the policing service.
