Title:Od Æthelberhta do Edgarja : razvoj anglosaškega prava v srednjem veku

Abstract:Magistrsko delo se osredotoča na razvoj pravnega sistema v anglosaški Angliji v obdobju od 7. do 10. stoletja. Preučuje nastanek kraljevih zakonikov, ki so vplivali tako na družbeni kot na politični kontekst. Za prvi zapisani zakonik je zaslužen kentski kralj Æthelberht, na njegove zakone pa so se navezovali tudi kasnejši kralji. Analizirani so izbrani zakoni, ki prikazujejo prehod iz lokalno prilagojenih pravil v sistematične kodekse, ki so bili še vedno pod velikim vplivom Cerkve. V sklopu kraljevih zakonikov se je simultano začelo oblikovati kazensko pravosodje, ki kot glavno kaznivo dejanje navaja krajo, omenjena sta tudi vloga prisege ter sam pravni postopek, ki obtoženca čaka po storjenem kaznivem dejanju. Kraljevi zakoniki so vsebovali tudi zakone, ki so se neposredno nanašali na položaj žensk v družbi, kar jasno prikazuje omejitve, s katerimi so se soočale.

Title:From Æthelberht to Edgar : the development of Anglo-saxon law in the middle ages
Abstract:The master's thesis focuses on the development of the legal system in Anglo-Saxon England from the 7th to the 10th century. It examines the emergence of Royal Codes which influenced both the social and political context. The first written code is credited to Æthelberht, King of Kent, and his laws were referred to by later kings. Selected laws are analysed to show the transition from locally adapted rules to systematic codes, which were still heavily influenced by the Church. In the context of royal legislation, criminal justice began to take shape simultaneously, with theft as the main offence, and the role of oaths and the legal process awaiting the accused after the commission of a crime are also mentioned. The Royal Laws also contained laws that directly addressed the position of women in society, which clearly illustrates the constraints they faced.
