Title:Ustavnopravne dimenzije regulacije sodelovalnega gospodarstva v Evropski uniji : doktorska disertacija

Abstract:Pospešen razvoj sodelovalnega gospodarstva je spodbudil ponovno oceno tradicionalnih regulatornih okvirov in obstoječih pravnih norm. Nekatere platforme sodelovalnega gospodarstva ponujajo kombinacijo sektornih in storitev informacijske družbe, kar jih opredeljuje kot hibridne entitete. Hkratna ponudba različnih vrst storitev zahteva določitev prevladujoče dejavnosti določene platforme, ki pa se presoja od primera do primera. Navedeno povzroča pravno negotovost in neskladno sodno prakso na nacionalni ravni. V doktorski disertaciji preučujemo vpliv izbire institucionalnih alternativ v okviru večstopenjskega vladanja v EU na pravni status hibridnih poslovnih modelov sodelovalnega gospodarstva, kot sta Uber in Airbnb, na enotnem trgu EU. Zastavili smo si naslednja vprašanja: Kako različni nacionalni predpisi vplivajo na delovanje in konkurenčnost platform sodelovalnega gospodarstva? Kakšno vlogo ima Sodišče EU pri oblikovanju pravnega okvira za platforme sodelovalnega gospodarstva? Kako izbrana institucionalna struktura vpliva na regulacijo hibridnih poslovnih modelov v EU? Kakšne so pravne in praktične posledice razlik v pristojnostih med institucijami EU in nacionalnimi institucijami pri regulaciji sodelovalnega gospodarstva? Pri tem je bil uporabljen pristop mešanih metod za analizo ključnih pravnih odločitev Sodišča EU in nacionalnih sodišč. V skladu z najnovejšo prakso Sodišča EU je platforma Airbnb obravnavana kot ponudnik storitev informacijske družbe ter kot takšna predmet določil Direktive o elektronskem poslovanju 2000/31/ES. Nasprotno pa je regulacija platforme Uber zaradi njegove opredelitve kot prevozniško podjetje predmet skupne pristojnosti med institucijami EU in državami članicami EU na področju prevoznih storitev. Disertacija tako sproža razpravo o ustreznosti obstoječega regulatornega okvira in analizira možnost vzpostavitve ustreznega institucionalnega okvira, bodisi centraliziranega na ravni EU bodisi decentraliziranega na ravni držav članic EU, ki bi zagotovil vsebinska pravila za celovito urejanje pravnega statusa hibridnih poslovnih modelov, kar bi omogočilo enotnejše pogoje za njihovo delovanje na enotnem trgu EU.

Title:Constitutional Dimensions of the Sharing Economy Regulation in the European Union
Abstract:The accelerated evolution of the collaborative economy has prompted a re-evaluation of traditional regulatory frameworks and a re-evaluation of existing legal norms. Some platforms in the collaborative economy offer a combination of sectoral and information society services, which characterises them as a hybrid entity. The concurrent provision of disparate types of services necessitates the determination of the predominant activity of a given platform on a case-by-case basis. This, in turn, gives rise to legal uncertainty and inconsistent case law at the national level. This doctoral thesis addresses the impact of the choice of institutional alternatives in the context of multilevel governance in the EU on the legal status of hybrid collaborative economy business models such as Uber and Airbnb in the EU single market. We posed ourselves the following questions: How do different national regulations affect the operation and competitiveness of collaborative economy platforms? What role does the Court of Justice of the European Union (CJEU) play in shaping the legal framework for collaborative economy platforms? How does the chosen institutional structure influence the regulation of hybrid business models in the EU? What are the legal and practical implications of differences in competences between EU institutions and national institutions in regulating the collaborative economy? The thesis employs a mixed-methods research approach to analyse pivotal jurisprudential decisions of the Court of Justice of the European Union (CJEU) and national courts. In accordance with the latest case law of the CJEU, the platform Airbnb is classified as a provider of information society services and, as such, falls under the provisions of the E-Commerce Directive 2000/31/EC. In contrast, the regulation of the platform Uber, due to its classification as a transport company, falls within the shared competences of EU institutions and EU Member States in the field of transport services. This dissertation thus raises a discussion on the adequacy of the existing regulatory framework and analyzes the possibility of establishing an appropriate institutional framework—either centralized at the EU level or decentralized at the Member State level—that would provide substantive rules for comprehensively regulating the legal status of hybrid business models, thereby enabling more uniform conditions for their operation within the EU single market.
