Title:Stvarnopravni in javnopravni vidiki graditve objektov : magistrsko delo

Abstract:Gradnja objekta je za vsakega posameznika velik strošek. Dandanes si le redko kdo lahko gradi objekt brez najema bančnega kredita. Ker so ti krediti večinoma dolgoročni in velikih vsot, se banka za svoje terjatve ustrezno zavaruje. Ena izmed možnosti, ki jo banke ponujajo v okviru ponudbe stanovanjskih kreditov je kredit z rastočo hipoteko, tudi, če nepremičnina še ni zgrajena. Bistvena razlika od klasičnega kredita je v dinamiki črpanja kredita in zahtevani dokumentaciji. Graditev objektov vključuje različne vidike, ki jih lahko razdelimo na stvarnopravne in javnopravne. Oba vidika sta pomembna pri načrtovanju, izvajanju in upravljanju gradbenih projektov in, če ju upoštevamo zagotavljata zakonitost gradnje ter dolgoročno pravno varnost vseh vpletenih strank. Ko enkrat pridobimo finančna sredstva za nakup parcele in gradnjo objekta, pa se lahko prične postopek pridobivanja gradbenega dovoljenja. Izkazati moramo pravico do gradnje in z zvezi s tem dokazilo o pravici graditi, ki je dokazilo o lastninski, o drugi stvarni pravici, drugi pravici na podlagi katere lahko na določenem zemljišču ali objektu izvajamo gradnjo. Vse podatke o parceli, zemljišču, ki jo imamo v lasti in na kateri bomo začeti gradnjo objekta vsebuje kataster nepremičnin. V primeru spreminjanja mej naše parcele, so nam pa na voljo postopki: parcelacije, komasacije, izravnava meje ali lokacijska izboljšava.

Title:Real law and public law aspects of building construction
Abstract:The construction of an object is a huge expense for each individual. Nowadays, hardly anyone can build a facility without taking out a bank loan. Since these loans are mostly long-term loans and large sums, the bank adequately insures its claims. One of the options that banks offer as part of the offer of home loans is a loan with a growing mortgage, even if the property has not yet been built. The essential difference from a classic loan is in the dynamics of drawing the loan and the required documentation. The construction of buildings includes various aspects, which can be divided into substantive and public. Both aspects are important in the planning, implementation and management of construction projects and, if taken into account, ensure the legality of construction and the long-term legal certainty of all parties involved. Once we have obtained funds for the purchase of the plot and the construction of the facility, the process of obtaining a building permit can begin. We have to prove the right to build and in this regard proof of the right to build, which is proof of ownership, other real right, other right on the basis of which we can carry out construction on a certain land or building. All information about the plot, the land we own and on which we will start the construction of the building is contained in the real estate cadastre. In the event of changing the boundaries of our plot, we have at our disposal procedures: parcelling, land consolidation, levelling the boundary or location improvement.
