Title:Preoblikovanje lastninske pravice v etažno lastnino : magistrsko delo

Abstract:Nastanek etažne lastnine je povezan s čedalje večjimi potrebami prebivalstva v mestih, kjer niso imeli več prostora zidati v širino, ampak so zidali v višino. Njeni začetki segajo v konec petdesetih let prejšnjega stoletja. Pravna ureditev tega področja najprej ni bila dobro urejena, tudi vpis posameznih delov v zemljiško knjigo ni bil možen, zato lahko še danes naletimo na stavbe, ki nimajo urejene etažne lastnine. Etažna lastnina je oblika lastninske pravice, ki predstavlja izjemo od splošnega načela stvarnega prava: superficies solo cedit  načela povezanosti zemljišča in objekta. Poznamo etažno lastnino v ožjem in širšem pomenu. Etažna lastnina v ožjem pomenu predstavlja lastnino posameznega dela stavbe in solastnino skupnih delov, v širšem pomenu pa celoto vseh pravnih razmerij glede vseh delov etažne lastnine v določeni stavbi. Področje etažne lastnine urejajo zlasti Stanovanjski zakon, Stvarnopravni zakonik in Zakon o vzpostavitvi etažne lastnine na določenih stavbah in o ugotavljanju pripadajočega zemljišča ter Zakon o zemljiški knjigi. Etažno lastnino predstavljajo posamezni ter skupni deli v stavbi. Skupni deli so lahko splošni skupni deli, ki so namenjeni uporabi vsem etažnim lastnikom, ter posebni skupni deli, ki so namenjeni uporabi le določenim etažnim enotam. Za oblikovanje etažne lastnine je pomembno, da ima stavba vsaj dva ali več posameznih delov ter da so stavba in njeni deli vpisani v kataster nepremičnin. Vpis v kataster se uredi na podlagi elaborata, ki ga po izmeri stavbe izdela geodet. Na podlagi tega elaborata lahko lastnik oz. solastniki zemljišča, na katerem stoji stavba, ki jo želijo etažirati, sklenejo pravni posel za oblikovanje etažne lastine. Etažna lastnina lahko nastane s pravnim poslom ali s sodno odločbo. Pri oblikovanju etažne lastnine se spremenijo položaji nepremičnin in nastanejo nove nepremičnine, zato pride do določenih pravnih posledic.

Title:Conversion of ownership right into condominium property
Abstract:Condominium ownership started to the needs of the population in cities, where they no longer had space to build in width, but instead they built in height. Its beginnings date back to the late 1950s. Initially it was not well regulated, and the registration of individual parts in the land register was not possible. That is why even today we can still find buildings that do not have properly regulated condominium ownership. Condominium ownership is a form of property right that represents an exception to the general principle of property law: superficies solo cedit - the principle of the connection of land and building. We know condominium ownership in the narrow and broad sense. Condominium ownership in the narrow sense represents the ownership of an individual part of a building and the co-ownership of common parts. In the broader sense, condominium ownership is the group of all legal relationships regarding all parts of condominium ownership in a particular building. The area of condominium ownership is regulated in particular by the Stanovanjski zakon, Stvarnopravni zakonik in Zakon o vzpostavitvi etažne lastnine na določenih stavbah in o ugotavljanju pripadajočega zemljišča, ter Zakon o zemljiški knjigi. Condominium ownership in a building is composed by individual and common parts. Common parts can be general common parts intended for use by all condominium owners, and special common parts intended for use only by certain condominium units. To form condominium ownership, it is important that the building has at least two or more individual parts and that the building and its parts are registered in the real estate cadastre. Registration in the cadastre is arranged on the basis of a study prepared by a surveyor after measuring the building. On the basis of this study, the owner or co-owners of the land on which the building stands, which they wish to divide into condominiums, can conclude a contract to form condominium ownership. Condominium ownership can be created with contract or by a court decision. When creating condominium ownership, the positions of real estate change and new real estates are created, which leads to certain legal consequences.
