Title:Civilnopravni in javnopravni vidiki postavitve naprav, ki izkoriščajo potencial sonca in vetra : magistrsko delo

Abstract:Magistrsko delo obravnava civilnopravne in javnopravne vidike postavitve sončnih in vetrnih elektrarn, pri čemer so skozi analizo relevantnih zakonskih pravil ter mnenj pravnih strokovnjakov predstavljene pravne podlage za njihovo umeščanje v prostor, pravnih institutih, ki omogočajo njihovo postavitev na tujih nepremičninah, ter zakonodajnih ukrepih za hitrejše umeščanje elektrarn v okolje. V posameznih poglavjih je predstavljena klasifikacija sončnih in vetrnih elektrarn in analizirane možnosti obravnave elektrarn kot sestavine, pritikline ali samostojne premičnine. Predstavljeni so tudi stvarnopravno in obligacijsko pravni instituti, na podlagi katerih se lahko elektrarne postavijo na tujih nepremičninah, s poudarkom na služnostih, stavbni pravici ter zakupni pogodbi. Delo se dotika tudi vprašanj zavarovanja terjatev s sončnimi in vetrnimi elektrarnami ter pravne posledice odsvojitve in obremenitve nepremičnin, na kateri so tovrstne naprave postavljene. Posebna pozornost je namenjena zakonodajnim okvirjem, s katerimi se želi doseči bolj trajnostna prihodnost in razvoj uporabe obnovljivih virov energije, s čimer bi se doseglo zmanjšanje emisij toplogrednih plinov. V delu je analiziran nacionalni energetski in podnebni načrt, v luči katerega je bila sprejeta nova zakonodaja, s katero se želi spodbuditi gradnjo elektrarn in v tej zvezi določa prednostna območja umeščanja naprav za proizvodnjo električne energije iz sonca in vetra, omogoča postavitev elektrarn na območju neizkoriščenega potenciala in celo obvezno namestitev elektrarn na novogradnjah, prizidkih in rekonstrukcijah parkirišč ali stavb, katerih tlorisna površina znaša najmanj 1.000 m2 oziroma na obstoječih objektih in parkiriščih, katerih tlorisna površina znaša najmanj 1.700 m2. Magistrsko delo se zaključuje v sklepu, v katerem so povzete ključne ugotovitve in poudarjene pomanjkljivosti.

Title:Civil and Public Law Aspects of the Installation of Devices Harnessing Solar and Wind Power
Abstract:This master’s thesis addresses civil and public law aspects of installing solar and wind power plants. Through an analysis of relevant legal provisions as well as the perspectives of respectable legal experts, reader is presented with legal foundations for installation, property and civil law institutions under which power plants can be installed on foreign real estate, and legislative measures to accelerate their integration into the environment. Individual chapters are devoted to the classification of solar and wind power plants and analyses the possibilities of treating them as components, appurtenances, or independent movable assets. The study also introduces property and contractual law institutes that allow power plants to be installed on foreign real estate, with a focus on easements, building rights, and lease agreements. Additionally, the thesis addresses the issue of securing claims with solar and wind power plants and the legal consequences of alienating and encumbering real estate where such installations are placed. Special attention is given to legislative frameworks aimed at achieving a more sustainable future and promoting the use of renewable energy sources to reduce greenhouse gas emissions. The thesis analyses the National Energy and Climate Plan, under which new legislation was adopted to encourage the construction of power plants. This legislation defines priority areas for the placement of solar and wind power generation facilities, allows the establishment of plants in untapped potential areas, and even mandates the installation of power plants on new buildings, extensions, and reconstructions of parking lots or buildings with a floor area of at least 1,000 m², as well as on existing structures and parking lots with a floor area of at least 1,700 m². The thesis concludes with a summary of key findings and highlights existing shortcomings.
