Title:Legal frameworks for promoting Eu sustainable development and tourism industry : master’s thesis

Abstract:The European Union (EU) has long emphasized sustainable development as a fundamental policy goal, particularly within its tourism industry, which accounts for approximately 10% of the EU’s GDP. This thesis explores the legal frameworks that promote sustainable tourism development in the EU, analyzing their effectiveness, challenges, and future directions. The study examines the interplay between sustainability principles and tourism regulation, focusing on EU treaties, directives, and strategies such as the European Green Deal, the Circular Economy Action Plan, the European Tourism Indicators System (ETIS) and others. The research assesses how legal mechanisms influence environmental protection, economic growth, and social inclusion within the tourism sector. It also investigates the implementation of EU green policies, analyzing their impact on tourism businesses and local communities. The study highlights best practices from member states, such as sustainable tourism initiatives in Slovenia, Spain, and Germany, illustrating the successful integration of environmental and economic objectives. Findings indicate that while the EU has made significant progress in promoting sustainable tourism, regulatory fragmentation, inconsistent enforcement across member states, and financial constraints hinder full implementation. Recommendations include enhancing regulatory harmonization, strengthening stakeholder collaboration, and leveraging digital tools to monitor sustainability performance thus contributing to the broader discourse on balancing economic growth with environmental responsibility.

Title:Pravni okviri za spodbujanje trajnostnega razvoja EU in turistične industrije
Abstract:Evropska unija (EU) že dolgo poudarja trajnostni razvoj kot temeljni politični cilj, zlasti v okviru turistične industrije, ki predstavlja približno 10 % BDP EU. Ta magistrska naloga preučuje pravne okvire, ki spodbujajo trajnostni razvoj turizma v EU, analizira njihovo učinkovitost, izzive in prihodnje smeri. Raziskava preučuje preplet načel trajnosti in pravne regulacije turizma ter se osredotoča na pogodbe EU, direktive in strategije, kot so Evropski zeleni dogovor, Akcijski načrt za krožno gospodarstvo in Evropski sistem kazalnikov za turizem (ETIS). Raziskava ocenjuje, kako pravni mehanizmi vplivajo na varstvo okolja, gospodarsko rast in socialno vključenost v turističnem sektorju. Prav tako analizira izvajanje zelenih politik EU in njihov vpliv na turistična podjetja ter lokalne skupnosti. Študija izpostavlja najboljše prakse iz držav članic, kot so trajnostne turistične pobude v Sloveniji, Španiji in Nemčiji, ki uspešno združujejo okoljske in gospodarske cilje. Ugotovitve kažejo, da je EU kljub pomembnemu napredku pri spodbujanju trajnostnega turizma še vedno soočena s težavami, kot so regulativna fragmentacija, neenotno izvajanje zakonodaje med državami članicami in finančne omejitve. Priporočila vključujejo krepitev usklajenosti predpisov, izboljšanje sodelovanja deležnikov ter uporabo digitalnih orodij za spremljanje trajnostne uspešnosti. S celovito analizo pravnega pristopa EU k trajnostnemu turizmu ta naloga prispeva k širši razpravi o uravnoteženju gospodarske rasti z okoljsko odgovornostjo. Poudarja nujnost prilagodljivih pravnih okvirov za zagotovitev dolgoročne vzdržnosti turistične industrije v skladu s cilji trajnostnega razvoja EU.
