Title:Prekrški zoper javni red in mir, storjeni na internetu, sedaj in v prihodnje

Abstract:Slovenski Zakon o varstvu javnega reda in miru (»ZJRM-1«, 2006) je star 18 let. V času njegovega nastanka internet še ni bil obravnavan kot javni kraj, kjer so lahko storjeni prekrški. Zato sedanja in prihodnja ureditev prekrškov zoper javni red na internetu postavlja nove dileme. Država mora namreč uravnotežiti svobodo izražanja z zaščito posameznikov pred škodljivimi vsebinami. Internet kot relativno anonimno okolje omogoča različne izraze, od konstruktivnih razprav do širjenja sovražnega govora in drugega družbeno škodljivega vedenja. Pri prihodnji ureditvi prekrškov zoper javni red na internetu je ključno uravnotežiti zaščito posameznika in ohranjanje odprtega, dostopnega prostora za izražanje. Drugi izziv je vprašanje nadzora in cenzure interneta. Kdo odloča, kaj je na internetu sprejemljivo in kaj ne? Posegi državnih organov in ponudnikov internetnih storitev lahko predstavljajo pri urejanju prekrškov nov okvir za tveganje eventualne zlorabe moči za politične, komercialne ali druge posebne interese. V prispevku bomo poskusili odgovoriti na ta vprašanja.

Title:Minor offences against public order committed on the internet now and in the future
Abstract:The Slovenian Public Order and Peace Act (»ZJRM-1«, 2006) is 18 years old. At its creation, the Internet was not yet considered a public place where minor offences could be committed. Therefore, the current and future regulation of minor offences against public order raises new dilemmas. As a relatively anonymous environment, the Internet allows various terms, from constructive debates to spreading hate speech. In the future regulation of minor offences against public order, it is crucial to balance the protection of the individual with the preservation of an open space for expression. The second challenge is the issue of Internet surveillance. Who decides what is acceptable on the Internet and what is not? Interventions by state authorities and Internet service providers may provide a new framework for the risk of possible abuse of power. In the article, we will try to answer these questions.
