Title:Diskurzivna analiza parlamentarne razprave ob sprejemanju novele družinskega zakonika : magistrsko delo

Abstract:Magistrsko delo prinaša rezultate kritične diskurzivne analize 2. redne seje Državnega zbora Republike Slovenije, na kateri je bil obravnavan predlog Zakona o spremembah Družinskega zakonika, ki je stopil v veljavo 31. januarja 2023. Temeljni namen magistrskega dela je prikazati diskurzivno konstrukcijo legitimacije oz. delegitimacije sprejetja novele Družinskega zakonika ter predstaviti razlike med pobudnicami in pobudniki ter nasprotnicami in nasprotniki novele z vidika vsebine diskurza in uporabljenih diskurzivnih strategij. Parlamentarna obravnava in sprejetje Zakona o spremembah Družinskega zakonika sta posledica odločb Ustavnega sodišča iz leta 2022, iz katerih izhaja, da je zakonska ureditev, ki določa, da lahko zakonsko zvezo skleneta le dve osebi različnega spola in da istospolna partnerja, ki živita v formalni partnerski zvezi, ne moreta skupaj posvojiti otroka, v neskladju z ustavno prepovedjo diskriminacije. Parlamentarni diskurz je bil ob sprejemanju novele Družinskega zakonika izrazito polariziran. V parlamenetarnih razpravah se je odražal širši družbeni konflikt med ohranjanjem tradicionalnih norm oz. vrednot ter prizadevanji za njihovo preoblikovanje v smeri večje enakosti in vključenosti marginaliziranih družbenih skupin. Diskurz pobudnic in pobudnikov novele Družinskega zakonika je bolj osredotočen na vsebino novele kot diskurz njenih nasprotnic in nasprotnikov. Slednji je vsebinsko heterogen in vključuje tudi vsebine, ki niso neposredno povezane s samo novelo. Pobudnice in pobudniki novele se osredotočajo na zakone in pravne akte ter strokovna mnenja, ki so neposredno povezana s sprejetjem novele Družinskega zakonika, medtem ko njene nasprotnice in nasprotniki vključujejo širši nabor tem, ki niso neposredno povezane z vsebino novele in pri tem računajo na podporo določenega dela volivk in volivcev. Nasprotnice in nasprotniki spremembe sprejetje novele delegitimirajo zlasti z reproduciranjem tradicionalnega koncepta družine in dehistorizirane konceptualizacije spola ter naturalizacijo prevladujoče hetero- in cisnormativne vizije družbe. Diskurz pobudnic in pobudnikov novele temelji na poudarjanju pomena pravne enakopravnosti ter družbene vključenosti vseh posameznic in posameznikov, ne glede na njihovo seksualno identiteto. Sprejetje novele utemeljujejo kot korak k pravičnejši družbi ter se sklicujejo na človekove pravice, enakost in solidarnost.

Title:The discursive analysis of parliamentary debate on the adoption of the amendment to the family code
Abstract:This master’s thesis presents the findings of a critical discourse analysis of the 2nd regular session of the National Assembly of the Republic of Slovenia, during which the proposed amendments to the Family Code were debated. The amended legislation entered into force on January 31, 2023. The primary objective of the thesis is to examine the discursive construction of the legitimation and delegitimation of the amendment’s adoption, and to identify the differences between its proponents and opponents in terms of discourse content and the discursive strategies employed. The parliamentary debate and subsequent adoption of the Family Code amendment were triggered by decisions of the Constitutional Court in 2022, which determined that the legal provisions restricting marriage to heterosexual couples and prohibiting same-sex partners in formal unions from jointly adopting children were inconsistent with the constitutional prohibition of discrimination. The parliamentary discourse surrounding the amendment was highly polarized. The debate reflected a broader social conflict between the preservation of traditional norms and values and efforts to reform them in the direction of greater equality and inclusion of marginalized social groups. The discourse advanced by proponents of the amendment was more focused on the substantive content of the legislation, whereas the discourse of its opponents was more heterogeneous and often extended to topics not directly related to the amendment. Proponents based their arguments on relevant legal frameworks and expert opinions directly associated with the legislative changes, while opponents drew upon a broader array of issues, frequently aiming to mobilize support from particular segments of the electorate. Opponents primarily sought to delegitimize the amendment by reproducing a traditional concept of the family, employing a dehistoricized understanding of gender, and naturalizing a dominant heteronormative and cisnormative conception of society. In contrast, the proponents’ discourse emphasized the importance of legal equality and social inclusion for all individuals, regardless of sexual identity. They framed the adoption of the amendment as a step toward a more just society, invoking principles of human rights, equality, and solidarity.
