Title:Neodvisnost sodstva kot merilo za pristop k Evropski uniji - primer Črne gore : magistrsko delo

Abstract:Magistrsko delo obravnava neodvisnost sodstva kot enega temeljnih elementov načela delitve oblasti in vladavine prava, pri čemer izhaja iz spoznanja, da kljub dolgotrajni zgodovinski prisotnosti ideje ta v celoti še ni uresničena v nobeni državi. Neodvisnost sodstva se pojmuje kot večplastno in kompleksno področje, na katerega vplivajo zakonodajni okviri, politične razmere in ekonomski pogoji, pa tudi stabilnost družbe in splošna zavest državljanov o pomenu pravne države ter vladavine prava. V državah z močno razvito pravno kulturo je neodvisnost sodstva bolje zaščitena, medtem ko v drugih državah še vedno obstajajo izzivi pri zagotavljanju njegove popolne avtonomije. Glede na pravni red Evropske unije, ki temelji na visokih standardih vladavine prava, osvetljujemo pomen neodvisnega sodstva kot ključnega zagotovila za stabilno delovanje institucij, varstvo človekovih pravic ter zagotavljanje enakosti pred zakonom. Posebna pozornost je namenjena prizadevanjem EU za krepitev neodvisnosti sodstva v državah kandidatkah. Unija jim namreč z različnimi mehanizmi strokovne, finančne in zakonodajne podpore pomaga pri prilagajanju zakonodaje z evropskimi standardi, zlasti na področjih, kot so vladavina prava, neodvisnost sodstva, spoštovanje človekovih pravic in krepitev demokratičnih institucij. V tem kontekstu je analiziran položaj Črne gore na poti k članstvu v Evropski uniji, pri čemer so preučeni doseženi premiki in odprti izzivi na področju sodne reforme. Izpostavljene so ključne vrzeli v črnogorskem sodstvu, na katere dosledno opozarjajo evropske institucije, ter ocenjen vpliv evropskih politik in instrumentov na postopno utrjevanje pravosodne neodvisnosti kot enega od osrednjih pogojev za nadaljnji napredek v pristopnem procesu.

Title:Independence of the Judiciary as a Criterion for Accession to the European Union - The Case of Montenegro
Abstract:The master's thesis examines the independence of the judiciary as one of the fundamental elements of the principle of separation of powers and the rule of law, based on the understanding that, despite its longstanding historical presence, this ideal has not yet been fully achieved in any country. Judicial independence is considered a multi-layered and complex field, influenced by legislative frameworks, political conditions, and economic circumstances, as well as by the stability of society and the general awareness of citizens regarding the importance of the rule of law. In countries with a well-developed legal culture, the independence of the judiciary is better safeguarded, while in others, challenges to ensuring its full autonomy persist. In line with the legal order of the European Union, which is founded on high standards of the rule of law, the significance of an independent judiciary is highlighted as a key guarantee for the stable functioning of institutions, the protection of human rights, and the provision of equality before the law. Special attention is given to the EU’s efforts to strengthen judicial independence in candidate countries. Through various mechanisms of professional, financial, and legislative support, the Union assists these countries in aligning their legal systems with European standards. Within this framework, the position of Montenegro on its path towards full membership in the European Union is analysed, focusing on the progress made and the remaining challenges in judicial reform. Key shortcomings in the Montenegrin judiciary, consistently emphasised by European institutions, are identified, and the influence of European policies and instruments on the gradual consolidation of judicial independence is assessed, as one of the essential conditions for further advancement in the accession process.
