Title:Območje gradbene parcele ter evidentiranje območja služnosti in stavbne pravice : magistrsko delo

Abstract:Magistrska naloga z naslovom ''Območje gradbene parcele ter evidentiranje območja služnosti in stavbne pravice'' je namenjena predvsem celostni in korektni predstavitvi novosti, ki jih v slovenski pravni red prinašata Zakon o katastru nepremičnin (ZKN) in Zakon o urejanju prostora (ZUreP-3). Oba zakona prinašata pomembne novosti predvsem na področju evidentiranja nepremičnin kot tudi novosti, ki so ključnega pomena v postopkih gradnje in ustanavljanja služnosti in stavbnih pravic. Nepremičninske evidence so že pred sprejemom ZKN imele ključno vlogo v postopkih z nepremičninami. Zemljiška knjiga, zemljiški kataster in kataster stavb so pred sprejemom ZKN bile matične nepremičninske evidence, kjer so se vodili podatki o nepremičninah. Ključno spremembo, napram prejšnji ureditvi, pa je prinesel nov zakon, ki je kot temeljno nepremičninsko evidenco postavil kataster nepremičnin, v kateri so združeni podatki, ki so se predhodno vodili v več različnih evidencah. Tako je ZKN celostno prenovil sistem evidentiranja nepremičnin v slovenskem pravu in, s poenotenjem, v postopke z nepremičninami prinesel večjo pravno varnost in zmanjšal možnost nastanka sporov. Kot eno izmed temeljnih sprememb je ZKN v slovenski pravni red prinesel tudi enotni katastrski postopek določitve območja služnosti in stavbne pravice. Območje pravic se po novi ureditvi določa s katastrskim postopkom in se določa, napram prejšnji ureditvi, z višjo stopnjo natančnosti in ne zgolj opisno. Določitev območja pa neposredno vpliva na možnost izvajanja pravic v praksi, kar pomeni da pravilna in natančna določitev območja pravice prispeva k stabilnosti tako pravnega promet kot k zmanjševanju negotovosti v stvarnopravnih razmerjih. Novost pa prinaša tudi ZUreP-3, ki postavlja obvezo vpisa območja gradbene parcele in njenih sestavin v kataster nepremičnin. Obveznost vpisa območja gradbene parcele bo tako igralo pomembno vlogo še posebej pri postopkih novogradenj, kjer bo ključnega pomena tudi korektna določitev območja služnosti in stavbne pravice. Kot slabost nove ureditve pa se pojavlja (ne)vzpostavitev sistema eGraditev, ki bo služil vpisu gradbene parcele v evidence, a bo v celoti vzpostavljen šele v začetku leta 2026. Nova ureditev na področju evidentiranja nepremičnin in s tem tudi nova nepremičninska evidenca, kataster nepremičnin, predstavljata korenito spremembo v slovenskem stvarnem pravu. Kljub temu da nova ureditev prinaša veliko pozitivnih sprememb, bo za nemoteno in korektno rabo potrebnega še precej časa in veliko previdnosti pri uporabi novih določb.

Title:Building plot area and registration of easement and building right zones
Abstract:The master's thesis titled "Building Plot Area and Registration of Easement and Building Right Zones" focuses on a comprehensive and accurate presentation of the legal novelties introduced into the Slovenian legal system by the Real Estate Cadastre Act (ZKN) and the Spatial Planning Act (ZUreP-3). These acts bring substantial innovations, particularly in the field of property registration and in procedures related to construction, easements, and building rights. Before the adoption of the ZKN, property records already played a central role in real estate procedures. The land register, land cadastre, and building cadastre were the main official records for property data. A fundamental change introduced by the new law is the establishment of the Real Estate Cadastre as the unified official property record, combining information previously kept in several different databases. This reform has increased legal certainty and reduced the risk of legal disputes.One of the key innovations is the implementation of a single cadastral procedure for defining easement and building right zones. These areas are now recorded with greater spatial precision, instead of merely being described textually. Accurate definition directly impacts the enforceability of rights, contributing to greater legal stability and reducing uncertainty in property law relationships.The ZUreP-3 further introduces the obligation to register the building plot area and its components in the Real Estate Cadastre. This obligation is especially important in new construction processes, where properly defined easement and building right zones will play a critical role. However, a current drawback is the incomplete implementation of the eGraditev (eConstruction) platform, which will enable digital registration of building plots and is expected to be fully operational by early 2026. The new legal framework and the introduction of a unified real estate record system represent a fundamental shift in Slovenian property law. Although the reform brings many improvements, its successful implementation will require time, caution, and consistency in the application of its new provisions.
