Title:Vpliv nasilja v družini na institut stanovanjskega varstva : magistrsko delo

Abstract:Nasilje v družini predstavlja enega izmed najbolj problematičnih in hkrati najbolj prikritih tem današnje družbe. Gre za izjemno občutljivo tematiko, o kateri se ne govori veliko, predvsem iz vidika, da se izvaja v družini, torej v prostoru, kjer bi naj posamezniki uživali zasebnost, ljubezen in varnost. Ko se prostor, ki ga posameznik dojema kot varnega, spremeni v vir nasilja, so posledice za žrtve pogosto hude in dolgotrajne. Nasilje že nasploh pomeni hudo kršitev osnovnih človekovih pravic. Kadar se pa ta izvaja v družinskem okolju, pa pomeni tudi kršitev medsebojnega zaupanja ter spoštovanja. Država ima dolžnost varovati človekove pravice, pri tem pa posebno pozornost namenja žrtvam družinskega nasilja, ki sodijo med najbolj ranljive skupine v družbi. Najpogostejše žrtve tovrstnega nasilja so ženske in otroci. Država nosi posebno odgovornost, da zagotovi ustrezne institute za zaščito vseh žrtev družinskega nasilja, pri čemer mora biti v primeru otrok še posebej skrbna. Celovito ureditev tega področja predstavlja Zakon o preprečevanju nasilja v družini (ZPND), kateri predvideva tudi ukrep za začasno razrešitev stanovanjske negotovosti žrtve, v kateri se znajde v trenutku, ko je primorana zaradi svoje varnosti zapustiti skupni dom, ki si ga deli s povzročiteljem nasilja. Čeprav ukrep predstavlja začasno varnost žrtvi in priložnost za življenja brez nasilja, smo kot družba odgovorni, da do problema pristopimo celovito – z ničelno toleranco do nasilja ter s ciljem, da do stanovanjske ogroženosti žrtve nasilja sploh ne prihaja.

Title:The impact of domestic violence on the institution of housing protection
Abstract:Domestic violence represents one of the most problematic and, at the same time, most hidden issues in today’s society. It is an extremely sensitive topic that is not often discussed, primarily because it occurs within the family – a space where individuals are expected to enjoy privacy, love, and safety. When a space perceived as safe becomes a source of violence, the consequences for the victims are often severe and long-lasting. Violence in general constitutes a serious violation of fundamental human rights. When it takes place within the family, it also represents a breach of mutual trust and respect. The state has a duty to protect human rights, with special attention given to victims of domestic violence, who are among the most vulnerable groups in society. The most common victims of such violence are women and children. The state bears a particular responsibility to provide adequate mechanisms for the protection of all victims of domestic violence, with special care required in the case of children. A comprehensive legal framework for this issue is provided by the Domestic Violence Prevention Act, which also includes a measure for temporarily resolving the housing insecurity that victims face when they are forced to leave the shared home for their own safety. Although this measure provides temporary safety and a chance for a life free from violence, society as a whole carries the responsibility to approach the problem comprehensively – with zero tolerance for violence and with the aim of preventing victims from experiencing housing insecurity in the first place.
