Title:Podatkovna zasebnost v pametnem domu: izbrani vidiki : magistrsko delo

Abstract:Tehnološko podprta arhitektura pametnega doma pretaka posameznikovo razumno pričakovano zasebnost ranljive domače intime v brezmejno okolje globalnega digitalnega oblaka velikega podatkovja. V naprave interneta stvari integrirano vseprisotno, pogosto nezaznavno zbiranje osebnih podatkov spodkopava učinkovitost vzpostavljenih temeljev varstva podatkov, ki v evropskem prostoru slonijo predvsem na Splošni uredbi o varstvu podatkov. Vrzeli v doslednem in učinkovitem uresničevanju načel omejitve namena, minimiziranja obsega zbiranja podatkov in informirane privolitve omogočajo bistveno podrobnejše oblikovanje profilov spremljanih posameznikov na podlagi neprekinjenega in celovitega zbiranja vedenjskih, kontekstualnih in biometričnih podatkov v okviru sistemu pametnega doma. V izrazitem nasprotju z naglim tehnološkim napredkom nevarno stagnira ozaveščenost posameznikov o preglednosti postopkov zbiranja in obdelave podatkov ter o naravi in razsežnostih digitalne vsepovezanosti, ki prinaša resna zasebnostna tveganja. Poglabljajo se neravnovesja moči med posameznikom, na katerega se nanašajo osebni podatki, in njihovimi upravljavci. Posledično narašča tveganje vzpostavitve prikritih in sistemskih oblik nadzora nad posameznikom, bodisi s strani državnih akterjev bodisi transnacionalnih tehnoloških korporacij. Uporabnik pametnega doma se pogosto znajde v paradoksalnem položaju, ko je obenem pasivni vir oziroma objekt zbiranja podatkov ter hkrati njihov posredni zbiralec in potencialni upravljavec. Formalno sicer upravlja pametni dom, vendar obseg njegovega dejanskega nadzora nad podatkovnimi tokovi pogosto ostaja skromen ali celo le navidezen. Za ohranitev tradicionalno visokega standarda varstva zasebnosti posameznikovega doma je potreben razmislek o premiku od pretežno deklarativnega nalaganja obveznosti upravljavcem velikega podatkovja pametnega doma k proaktivni in vsebinsko okrepljeni regulaciji zbiranja in obdelave podatkov.

Title:Data privacy in the smart home: selected aspects
Abstract:A technologically enabled smart home architecture streams an individual's reasonable expectation of privacy within the vulnerable intimacy of the domestic sphere into the boundless realm of the global digital cloud of big data. The ubiquitous, often imperceptible collection of personal data, embedded in Internet of Things devices undermines the effectiveness of established data protection frameworks, which in the European context are primarily grounded in the General Data Protection Regulation. Gaps in the consistent and effective implementation of the principles of purpose limitation, data minimization and informed consent enable significantly more granular profiling of monitored individuals based on the continuous and comprehensive collection of behavioral, contextual and biometric data within the smart home system. In stark contrast to the rapid pace of technological advancement, awareness among individuals regarding the transparency of data collection and processing practices, as well as the nature and scope of digital hyperconnectivity, which entails serious privacy risks, is dangerously stagnating. Power imbalances between data subjects and data controllers are deepening, increasing the risk of covert and systemic forms of surveillance over individuals, whether by state actors or transnational technology corporations. The smart home user often finds themselves in a paradoxical position of being both a passive source or object of data collection and at the same time an indirect collector and potential controller of data. While they may formally operate the smart home, the extent of their actual control over data flows often remains modest or even illusory. To maintain the traditionally high standard of privacy protection within the individual’s home, it is necessary to reconsider a shift from the predominantly declaratory imposition of obligations on smart home big data controllers toward a proactive and substantively strengthened regulation of data collection and processing.
