Title:Neenako priznavanje odvetniških stroškov v slovenski sodni praksi : magistrsko delo

Abstract:Odvetništvo je samostojna in neodvisna služba, ki je urejena s pravnimi akti. Ker samostojnost odvetništva pomeni organizacijsko neodvisnost od državne oblasti, tudi odvetniške stroške odvetništvo ureja samo. Odvetniki se lahko za plačilo dogovorijo na različne načine, in sicer se lahko glede plačila dogovorijo s stranko ali pa jim stroške krije državni proračun v zvezi z odobreno brezplačno pravno pomočjo ali pri zastopanju po uradni dolžnosti. Največja problematika se pojavi, da sodišča in drugi državni organi priznavajo odvetniške stroške v teh dveh primerih, pri čemer zaradi pavšalno urejene zakonodaje prihaja do neenotne sodne prakse in različne uporabe določb v praksi. Odvetniška tarifa je temelj za obračunavanje odvetniških stroškov, Odvetniška zbornica Slovenije pa je tudi sprejela obvezne razlage in pojasnila v zvezi s priznavanjem odvetniških stroškov s strani sodišč, ravno z namenom, da bi bile določbe jasnejše. Veliko je vprašanj, kako se določeni odvetniški stroški priznavajo v praksi. Eni izmed teh sta zagotovo konferenca s stranko in študij spisa. Večinsko mnenje sodišč je, da so te storitve že vštete v storitve zastopanja stranke, saj zastopanje ni možno brez predhodnega pogovora s stranko in študijem vseh listin, vendar se v nekaterih primerih konferenca s stranko in študij spisa štejeta kot samostojni storitvi. Dileme se pojavljajo prav tako pri priznavanju potnih stroškov in stroškov za odsotnost iz pisarne. V kazenskem postopku pa je recimo tudi problematično vprašanje zaključna beseda, saj se slednja lahko poda ustno na zapisnik na zadnjem naroku ali vloži tudi pisno, zato se tukaj pojavlja vprašanje, ali se v slednjem primeru lahko prizna kot obrazložena vloga. So pa še nekateri dejavniki, ki lahko vrednost storitev tudi zvišajo. Med drugim je to vlaganje pravnega sredstva zoper meritorno ali nemeritorno odločbo ali zastopanje stranke za več kaznivih dejanj hkrati ali nadaljevalno kaznivo dejanje. Posebnost pa se pojavi tudi pri izvensodnih postopkih, recimo pri mediaciji, in sicer pri sklenitvi sodne poravnave v postopku mediacije, saj prav tako lahko privede do velikih odstopanj glede na to, v katerem delu postopka je bila poravnava sklenjena.

Title:Unequal recognition of attorney´s fees in slovenian case law
Abstract:The legal profession is an independent and autonomous service managed by legal acts. Since the independence of the legal profession means organizational autonomy from authorities, attorney’s fees are independently regulated by the legal profession itself. Attorneys may agree on the method of payment in various ways, either by reaching an agreement directly with the client, or are costs covered by the state budget in relation to legal aid or ex offo representation. The biggest problem is how courts and other state authorities recognize attorney’s fees in these two cases, as due to deficient legislation there is inconsistent case law and different application of legal acts in practice. The Attorney’s Tariff is the basis for calculating attorney’s fees. The Slovenian Bar Association has also adopted mandatory interpretations and clarifications regarding the recognition of attorney’s fees by courts, with aim to make certain provisions better. There are many questions of how specific legal services are recognized in practice; two such services are certainly client conferences and case study. The prevailing opinion of courts is that these services are already included in the representation of client, since effective representation is not possible without a meeting with the client and a review of relevant documents. However, in certain cases a client conference and file review can be treated as independent services. Further problems arise in the recognition of travel expenses and compensation for time spent away from the office. In criminal proceedings an issue is also the closing argument, which may either be presented orally at the final hearing or in writing. In such cases, the question arises whether the written closing argument qualifies as a reasoned application. There are also many circumstances that may increase the value of individual services. These include among others filing legal remedies against substantive or procedural decisions, or representing a client charged with multiple crimes or a continuing crime. Special considerations arise in other procedures, such as mediation, especially regarding the conclusion of a settlement during mediation. This can lead to various solutions depending on the stage of the proceedings at which the settlement is reached.
