Title:Učinkovitost ureditve stikov z otroki po spremembi družinskopravne zakonodaje : magistrsko delo

Abstract:Otroci so najbolj ranljiv del naše družbe, zaradi česar jim pripada posebno pravno varstvo. Izvrševanje stikov je za otroke ključnega pomena, saj se s tem ohranja čustvena navezanost s staršem ali drugo osebo, ki je otroku blizu. Magistrska naloga bolj podrobno obravnava spremembe družinskopravne zakonodaje na področju ureditve stikov otrok, pri čemer se v določenih delih osredotoča na pomanjkljivosti v trenutni ureditvi. V praksi je namreč še vedno mogoče najti situacije, v katerih stiki otrok s starši ali drugimi osebami niso urejeni dovolj celovito. Vsled navedenemu se v magistrski nalogi kot glavni pojavita vprašanji, ali je uveljavitev novega Družinskega zakonika zares pripomogla k bolj jasni in celoviti ureditvi stikov otrok s starši in drugimi osebami ter vprašanje, ali se kljub prenovi družinskopravne zakonodaje in vedno bolj obsežni sodni praksi še vedno pojavljajo pravne praznine na področjih, ki urejajo stike otrok v bolj specifičnih primerih, zaradi česar bi bila potrebna dodatna izpopolnitev oziroma delna prenovitev zakonodaje na tem področju po zgledu dobrih praks iz primerljivih tujih ureditev. Magistrska naloga se z namenom rešitve postavljenih pravnih vprašanj uvodoma dotakne družinskopravnih institutov, kasneje pa natančno analizira ključne spremembe družinskopravne zakonodaje na področju otrokovih stikov in poudarja njene pomanjkljivosti ter v določenih delih hkrati obravnava mogoče izboljšave oziroma rešitve za dane pravne praznine. Ob tem se naloga osredotoča na načelo otrokove koristi in čustvene navezanosti otrok na starše in druge njemu bližnje osebe. Namen magistrske naloge je prispevati k boljšemu razumevanju aktualne ureditve otrokovih stikov ter ponuditi izhodišča za morebitne izboljšave na podlagi izbranih primerov iz tujine.

Title:Effectivness of child contact arrangements after the amendment of family law legislation
Abstract:Children are the most vulnerable part of our society, which is why they are entitled to special legal protection. The exercise of contact (visitation) rights is of key importance for children, as it helps maintain their emotional bond with a parent or another person close to them. This master's thesis examines in more detail the changes in family law legislation regarding the regulation of children's contact rights, focusing in certain parts on the shortcomings of the current legal framework. In practice, situations can still be found where children's contact with parents or other individuals is not sufficiently comprehensively regulated. In light of the above, the thesis primarily addresses two key questions: whether the implementation of the new Family Code has genuinely contributed to a clearer and more comprehensive regulation of children’s contact with parents and other individuals, and whether legal gaps still exist in more specific cases—despite the reform of family law and increasingly extensive case law—thus necessitating further improvements or partial revisions of the legislation in this area, inspired by good practices from comparable foreign legal systems. To answer these legal questions, the thesis initially touches upon family law institutions, and later provides a detailed analysis of the key changes in family law related to children's contact. It highlights shortcomings in the legislation and, in certain parts, also explores possible improvements or solutions for the identified legal gaps. The thesis emphasizes the principle of the best interests of the child and the emotional attachment of children to their parents and other close individuals. The aim of the master's thesis is to contribute to a better understanding of the current regulation of children's contact rights and to offer a basis for potential improvements, drawing on selected examples from abroad.
