Title:Povezane nepremičnine z različnimi namenskimi rabami : magistrsko delo

Abstract:Magistrska naloga z naslovom »Povezane nepremičnine z različnimi namenskimi rabami« analizira institut povezanih nepremičnin, ki je bil v slovenski pravni red vpeljan z novelo SPZ-B. Gre za razmeroma nov pravni institut, katerega namen je omogočiti funkcionalno povezovanje nepremičnin, ki so trajno potrebne za rabo glavne nepremičnine. Institut povezanih nepremičnin določa, da lahko lastnik ali imetnik stavbne pravice na pomožni nepremičnini to nepremičnino trajno poveže s svojo lastninsko ali stavbno pravico na glavni nepremičnini. Posledično so tako predmet razpolaganja kot celota. Podobnost instituta povezanih nepremičnin z etažno lastnino se kaže predvsem v tem, da ureja pravna razmerja med več osebami in določa omejitve pri razpolaganju z določenimi nepremičninami. Kljub temu pa obstajajo pomembne razlike, saj etažna lastnina primarno ureja razmerja med solastniki posameznih delov stavbe, medtem ko institut povezanih nepremičnin obsega tako stavbe kot tudi druge vrste zemljišč. Ureditev povezanih nepremičnin nedvomno predstavlja pomemben korak k bolj fleksibilni in funkcionalni rabi nepremičnin. Predstavlja dobre temelje za nadaljnji razvoj tega instituta. Vsekakor pa bo na tem področju treba še veliko narediti, predvsem dopolniti nekatere zakonske pomanjkljivosti, morebitne nejasnosti pa odpraviti.

Title:Linked immovable properties of different purposeful use
Abstract:The master's thesis etitled »Linked Immovable Properties of Different Purposeful Use« examines the legal concept of linked immovable properties, which was introduced into Slovenian law through the SPZ-B amendment. This relatively new legal institution aims to facilitate the functional connection of immovable properties that are permanently required for the use of the primary property. According to the institute of linked immovable properties, the owner or the holder of a building right on an auxiliary property can permanently connect that property with their ownership or building right on the main property. Consequently, both properties are considered as a single entity for purposes of disposition. The similarity between the concept of linked immovable properties and condominium ownership primarily lies in the fact that both regulate legal relationships among multiple parties and impose restrictions on the disposal of certain properties. However, significant differences exist, as condominium ownership mainly governs relations between co-owners of individual parts of a building, whereas the institute of linked immovable properties applies not only to buildings but also to other types of land. The regulation of linked immovable properties undoubtedly represents a significant step towards more flexible and functional use of immovable properties, laying a solid foundation for further development of this legal institution. Nevertheless, much work is still to be done in this area, particularly to address certain legislative gaps and clarify any potential ambiguities.
