Title:Duševno zdravje kot univerzalna pravica človeka s poudarkom na ciljih trajnostnega razvoja : magistrsko delo

Abstract:Pravica do duševnega zdravja je sestavni del in temeljni del pravice do zdravja, ki je univerzalna človekova pravica. Osebe s težavami v duševnem zdravju so zaradi sistemskih kršitev, ki izvirajo iz prevladujočega biomedicinskega modela duševnega zdravja, pod vprašaj postavile univerzalnost pravice do duševnega zdravja, k uresničevanju katere so se države zavezale s številnimi pravnimi akti na vseh ravneh. Magistrsko delo preučuje pravno ureditev duševnega zdravja ter storitev in oskrbe za zagotavljanje duševnega zdravja v Sloveniji in njeno skladnost z mednarodnimi standardi. Pravna ureditev storitev in oskrbe za zagotavljanje duševnega zdravja namreč lahko poseže v univerzalnost pravice do duševnega zdravja. Poseben poudarek je na trajnostnem uresničevanju pravice do duševnega zdravja, h kateremu se je Slovenija prav tako zavezala tako na nacionalni kot tudi mednarodni ravni. Magistrsko delo ugotavlja, da poseg v pravico do duševnega zdravja posameznika predstavlja že nezadostna mreža za zagotavljanje duševnega zdravja, ki mora vključevati tudi dostopnost raznovrstnih storitev in oskrbe.

Title:Mental health as a universal human right with a focus on the Sustainable Development Goals
Abstract:The right to mental health is an integral and fundamental part of the right to health, which is a universal human right. Individuals with mental health difficulties have called into question the universality of this right due to systemic violations stemming from the dominant biomedical model of mental health. Yet, states have committed to realizing this right through numerous legal instruments at all levels. This master's thesis examines the legal framework governing mental health, as well as the services and care provided to ensure mental well-being in Slovenia and evaluates its compliance with international standards. The legal regulation of mental health services and care can impact the universality of the right to mental health. Special emphasis is placed on the sustainable realization of the right to mental health, to which Slovenia has likewise committed at both national and international level. The thesis finds that a lack of adequate service networks for mental health - particularly the lack of accessible and diverse services and care - already constitutes an infringement on an individual's right to mental health.
