Title:Prednosti in izzivi alternativnih sankcij : diplomsko delo visokošolskega študijskega programa Informacijska varnost

Abstract:Diplomsko delo obravnava alternativne sankcije kot vse pomembnejši element sodobnega kazenskega sistema, ki v ospredje postavlja rehabilitacijo, reintegracijo storilcev in zagotavljanje varnosti za širšo javnost. Ukrepi, kot so delo v splošno korist, pogojna obsodba, elektronski nadzor in poravnave z žrtvami, omogočajo bolj prilagodljiv in human pristop h kaznovanju. Osredotočeni so na trajnostno spremembo vedenja in zmanjšanje tveganja ponovitve kaznivih dejanj. Osnovni namen alternativnih sankcij je preseči tradicionalno, strogo kaznovalno politiko, temelječo na pogosti uporabi zapornih kazni, ki se v več primerih izkaže kot neučinkovita, zlasti pri storilcih manjših kaznivih dejanj. Sodobni kazenski sistemi stremijo k temu, da bi kaznovanje prispevalo k ponovni vključitvi storilcev v družbo, ne pa k njihovi izolaciji. Čeprav alternativne sankcije predstavljajo obetaven način kaznovanja z vidika ekonomske učinkovitosti in socialne rehabilitacije, je njihova uspešna implementacija mogoča le ob celoviti sistematični oceni, uskladitvi praks med različnimi področji ter nenehnem spremljanju in prilagajanju programov, ki še niso razviti v celoti. Med ključne prednosti spadajo zmanjšanje stroškov zapiranja, večja individualizacija kaznovanja in večja vključenost skupnosti, medtem ko so izzivi povezani z neenotno prakso, pomanjkanjem kadrovskih virov in nezadostnim nadzorom nad izvajanjem ukrepov.

Title:Advantages and challenges of alternative sanctions
Abstract:The thesis discusses alternative sanctions as an increasingly important element of the modern criminal justice system, which emphasises rehabilitation, the reintegration of offenders, and ensuring public safety. Measures such as community service, suspended sentences, electronic monitoring, and victim-offender mediation enable a more flexible and humane approach to punishment. These sanctions focus on sustainable behavioural change and reducing recidivism. The primary aim of alternative sanctions is to move beyond the traditional, strictly punitive policy, which relies heavily on imprisonment and often proves ineffective, especially for minor offences. Modern criminal justice systems strive to ensure that punishment contributes to the reintegration of offenders into society, rather than their isolation. Although alternative sanctions offer a promising approach to punishment in terms of cost-effectiveness and social rehabilitation, their successful implementation requires comprehensive and systematic evaluation, harmonisation of practices across different sectors, and ongoing monitoring and adaptation of programs, which are not yet fully developed. Key advantages include reduced incarceration costs, greater individualisation of punishment, and increased community involvement. On the other hand, challenges persist due to inconsistent practices, limited human resources, and insufficient oversight of the implementation of these measures.
