Title:Trgovina z ljudmi v Sloveniji - analiza izbranega primera : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomsko delo obravnava problematiko trgovine z ljudmi, ki resno posega v temeljne človekove pravice žrtev. Na podlagi pregleda domače in tuje literature so podane opredelitve trgovine z ljudmi in njenih pojavnih oblik ter predstavljeni načini novačenja žrtev. Analizirane so bile značilnosti trgovine z ljudmi v Sloveniji in obravnavani trije kriminalistični vidiki – odkrivanje, preiskovanje in dokazovanje tovrstne kriminalitete. Poleg tega so predstavljeni programi pomoči, ki jih v Sloveniji izvajajo pristojne dobrodelne in nevladne organizacije. S ciljem pridobitve dodatnega vpogleda v značilnosti in izzive preiskovanja trgovine z ljudmi v Sloveniji je bil analiziran primer osebe z izkušnjo trgovine z ljudmi, ki je bila kot mladoletno dekle iz Makedonije prodana družini v Mariboru. Analiza je bila opravljena na podlagi informacij, pridobljenih v okviru intervjuja z Društvom Ključ – center za boj proti trgovini z ljudmi v okviru projekta Erasmus+ Joint eStories: Journeys from Fear to Fair (JeS). Pri analiziranem primeru je bilo prisotnih več oblik zlorabe, in sicer prisilna poroka, prisilno delo, služabništvo, spolno izkoriščanje, psihično in fizično nasilje, omejevanje gibanja in prehranjevanja ter nadzor nad komunikacijami. Osebi z izkušnjo trgovine z ljudmi je bila po pobegu skozi celoten postopek zagotovljena podpora, najprej je bila nameščena v krizno namestitev Slovenske karitas, nato pa vključena v programa varna namestitev in reintegracija Društva Ključ – centra za boj proti trgovini z ljudmi, kjer je prejela celostno zdravstveno oskrbo, psihosocialno in pravno podporo, vključno s čustveno podporo pred pričanjem in z vključitvijo v srednješolsko izobraževanje. V času preiskovanja in obravnave na sodišču so se pojavile tri ovire, in sicer jezikovna ovira, nepravočasno dokumentiranje časovno občutljivih dokazov in nespoštljiv odnos zagovornikov obdolženih do osebe z izkušnjo trgovine z ljudmi. Kljub izzivom je bil kazenski postopek zaključen z obsodbami storilca in sostorilcev, oseba z izkušnjo trgovine z ljudmi pa si je po zaključku programov pomoči ustvarila novo življenje.

Title:Trgovina z ljudmi v Sloveniji, analiza izbranega primera
Abstract:This thesis addresses the issue of human trafficking, which constitutes a severe violation of the fundamental human rights of its victims. Based on a review of domestic and international literature, the work provides a definition of human trafficking and describes its various forms, as well as the methods used for the recruitment of victims. The thesis further analyses the characteristics of human trafficking in Slovenia and examines three key criminological dimensions of this form of crime – detection, investigation, and prosecution. In addition, assistance programs implemented in Slovenia by relevant charitable and non-governmental organizations are presented. With the aim of gaining additional insight into the characteristics and challenges of investigating human trafficking in Slovenia, a case study was analysed of a person with experience of human trafficking who, as a minor girl from Macedonia, was sold to a family in Maribor. The case analysis was based on information obtained through an interview conducted with Društvo Ključ – center za boj proti trgovanju z ljudmi as part of the Erasmus+ project Joint eStories: Journeys from Fear to Fair (JeS). The analysed case involved several forms of abuse, specifically forced marriage, forced labour, servitude, sexual exploitation, psychological and physical violence, restriction of movement and food, and control over communications. Following her escape, the person with lived experience of human trafficking was provided with continuous support throughout the process. She was first placed in emergency accommodation provided by Caritas Slovenia, and then enrolled in the safe accommodation and reintegration programs of The Society Ključ – Center for fight against trafficking in human beings, where she received comprehensive healthcare, psychosocial and legal support, including emotional support prior to testifying and enrolment in secondary education. During the investigation and judicial proceedings, three obstacles arose: a language barrier, untimely documentation of time-sensitive evidence, and disrespectful treatment of the victim by the defendants' lawyers. Despite these challenges, the criminal proceedings concluded with the conviction of the perpetrator and accomplices, and the person with lived experience of human trafficking was able to build a new life after leaving support programs.
