Abstract:V prispevku se ukvarjamo s konkurenco prenosa terjatve v izvršilnem postopku z zgodnejšim pogodbenim odstopom istih terjatev v zavarovanje. V primeru večkratnega globalnega anticipiranega fiduciarnega odstopa istih bodočih terjatev je treba dati prednost časovno prvi anticipirani cesiji. Ko terjatev nastane, preide na tistega fiduciarja, v korist katerega je bil sporazum o anticipiranem odstopu v zavarovanje sklenjen časovno prej. Prevedeno na položaj, o katerem razpravljamo v tem prispevku, pomeni, da je treba v primeru konkurence med prostovoljnim fiduciarnim odstopom bodočih terjatev in prisilnim prenosom bodočih terjatev (ki glede vrstnega reda učinkuje od trenutka rubeža terjatve) uporabiti pravilo iz tretjega odstavka 207. člena SPZ, ki ureja konkurenco večkratnih fiduciarnih odstopov terjatev, saj imajo tudi prisilni prenosi terjatev fiduciarno naravo.

Title:Conflict of (forced) transfer of receivables in enforcement proceedings with earlier contractual assignment of the same receivables as collateral
Abstract:This paper deals with the conflict of transfer of receivables in enforcement proceedings with earlier contractual assignment of the same receivables as collateral. In the case of multiple global anticipatory fiduciary assignment of the same future receivables, priority must be given to the first anticipated assignment. When the claim arises, it passes to the fiduciary in whose favor the anticipated assignment agreement was concluded earlier. Translated to the situation discussed in this article, this means that in case of competition between voluntary fiduciary assignment of future receivables and forced transfer of future receivables, the rule from the Article 207 SPZ must be applied, which regulates competition of multiple fiduciary assignments. Forced transfers of receivables (in enforcement proceedings) also have a fiduciary nature.
