Title:Položaj delavcev migrantov iz tretjih držav v primerjavi z delavci migranti, ki so državljani EU

Abstract:Medtem ko države članice ne smejo diskriminirati državljanov drugih držav članic v primerjavi z lastnimi državljani, jim je razlikovanje v veliki meri dovoljeno glede državljanov tretjih držav. Prispevek se osredotoča na možnosti za izboljšanje položaja delavcev, ki so državljani tretjih držav, na podlagi obstoječih pravnih in političnih okvirov glede njihovega mesta na trgu dela v EU, predvsem glede migracijskih pravic (v prvi vrsti pravica do prostega gibanja in prebivanja na ozemlju druge države članice). Glede tega se v kratkem obetajo spremembe, saj Evropski parlament in Svet EU obravnavata sveženj predlogov sprememb sekundarne zakonodaje EU v okviru »Novega pakta o migracijah in azilu«.

Title:The position of migrant workers from third countries in comparison with EU migrant workers
Abstract:While EU Member States are not allowed to discriminate against nationals of other Member States compared to their own nationals, they are largely allowed to apply differential treatment against third-country nationals. This paper focuses on the possibilities for improving the situation of third-country national workers, based on the existing legal and policy frameworks regarding their place in the EU labour market, in particular with regard to migration rights (primarily the right to move and reside freely within the territory of another Member State). In this respect, changes are imminent as the European Parliament and the Council of the EU are considering a package of proposals for amendments to EU secondary legislation in the framework of the 'New Pact on Migration and Asylum’.
