Title:Odškodninska odgovornost zdravnika in terapevtska svoboda

Abstract:V prispevku se po kriterijih, ki se uporabljajo v odškodninskih sporih v Sloveniji, kjer se ugotavlja, ali je prišlo do zdravniške napake pri uporabi določene metode konvencionalne medicine, analizira, ali (in kdaj) lahko pomeni zdravnikova uporaba posamezne metode nekonvencionalne medicine zdravniško napako in posledično tudi morebitno odškodninsko odgovornost zdravnika zaradi kršitev medicinskih standardov. Navedeno vprašanje je povezano z razumevanjem pojma terapevtska svoboda in terminologijo s področja nekonvencionalne medicine. Ker ne obstajajo pravila za »pravilno zdravljenje« posameznika, tudi ni mogoče postaviti splošnih pravil glede napačnega ravnanja pri izbiri metode zdravljenja. Bistveno pri zdravnikovem postopku odločanja in tehtanja glede uporabe metode nekonvencionalne medicine je, da je ravnal s skrbnostjo strokovnjaka dobrega zdravnika in opravil ustrezno pojasnilno dolžnost v zvezi z izbiro metode zdravljenja ter v tem okviru tudi upošteval pacientovo voljo in njegovo pravico do soodločanja.

Title:Malpractice liability of physician and therapeutic freedom
Abstract:The subject of the contribution is an analysis of whether and when a physician's employment of a particular unconventional medicine method may be considered a medical error, potentially incurring the physician's liability for violating medical standards, based on criteria used in Slovenian compensation disputes. This issue ties into the concept of 'therapeutic freedom' and the terminology associated with unconventional medicine. Since no definitive rules exist for the 'proper treatment' of an individual, it is equally challenging to set universal standards for malpractice in the selection of a treatment method. Central to the physician's decision-making process in employing unconventional medicine is the expectation that they act with the diligence of a skilled professional (good physician) and fulfill their duty to adequately inform the patient regarding the chosen treatment method, while also respecting the patient's will and their right to participate in decision-making.
