Title:Usmeritve varuha človekovih pravic policiji v obdobju 2019-2024 : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo preučevali tematiko usmeritve Varuha človekovih pravic Republike Slovenije policiji v obdobju 2019ꟷ2024, s posebnim poudarkom na analizi priporočil in usmeritev v zvezi z uporabo prisilnih sredstev in spoštovanjem človekovih pravic pri izvajanju policijskih nalog. Spoštovanje človekovih pravic je temelj zaupanja med policijo in družbo. Problematika zaupanja družbe v policijo je skozi zgodovino neprestano nihala, a še vedno ostaja prisotna v sodobnem času. Zato je pomembna vloga varuha, ki daje letna priporočila MNZ in policiji, da se zavzemata za doseganje teh ciljev za nadgradnjo strokovnosti in spoštovanja človekovih pravic v policijskih postopkih. Pri tem je pomembno poudariti, da je nadaljnje izobraževanje in spremljanje novih trendov ključno za ohranitev zaupanja javnosti v delo policije. V diplomskem delu smo obravnavali razvoj slovenske policije od prehoda iz centraliziranega vodenja k osamosvojitvi leta 1991. Skozi zgodovinska obdobja smo predstavili razvoj in uporabo prisilnih sredstev v slovenski policiji, s poudarkom na zakonodajni osnovi ter ureditvah, ki so urejale uporabo prisilnih sredstev. V času pandemije covid-19 se je povečalo število primerov, ko so bili posamezniki ter večja množica ljudi izpostavljeni nepotrebni uporabi sile in prisilnih sredstev, kar je pogosto vodilo v kršitve pravice do osebne nedotakljivosti in prepovedi mučenja ali drugih oblik nečloveškega ravnanja. S tem namenom smo analizirali končno poročilo varuha o policijskih postopkih pri izvajanju nalog vzdrževanja javnega reda v okviru spremljanja neprijavljenega shoda v Ljubljani, ki preučuje pravne in etične vidike uporabe prisilnih sredstev, skupaj z referencami na pomembne raziskave in publikacije.

Title:The ombudsmans guidelines for the police in the period 2019-2024
Abstract:In this thesis, we examined the guidelines of the Human Rights Ombudsman for the police in the period 2019–2024, with a particular focus on analyzing recommendations and guidelines regarding the use of coercive measures and respect for human rights in the preformance of police duties. Respect for human rights is the fundation for trust in the police and society. The issue of public trust in the police has fluctuated throughout history and remains present in modern times. This is why the Ombudsman plays an important role in issuing annual recommendations to the Ministry of the Interior and the police to strive to achieve these goals in order to improve professionalism and respect for human rights in police procedures. It is important to emphasize that further education and monitoring of new trends are crucial for maintaining public trust in the work of the police. In this thesis, we examined the development of the Slovenian police since the transition from centralized manegement to independence in 1991. we presented the development ad use of coercive measures in the Slovenian police throughout historical periods, with an emphasis on legislative basis and regulations governing the use of coercive measures. During the Covid-19 pandemic, there were increased cases where individuals and larger crowds of people were exposed to unnecessary use of force and coercive measures, which often led to violations of the right to personal integrity and the prohibition of torture or other forms of inhuman treatment. To this end, we analyzed the Ombudsmanˈs final report on police procedures in the preformance of public order maintenance tasks in the context of monitoring an unregistered gathering in Ljubljana, which examines the legal and ethical aspects of the use of coercive measures, along with refrences to relevant research and publications.
