Title:Primerjava ureditve preiskave in zasega po ameriškem in slovenskem kazenskem procesnem pravu : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V zaključnem delu primerjamo ureditvi preiskav in zasegov z vidika varstva pravice do zasebnosti v Združenih državah Amerike in Republiki Sloveniji. V prvem delu zaključnega dela obravnavamo ustavno ureditev varstva pravice do zasebnosti v kazenskem procesnem pravu Združenih držav Amerike, torej dopustnost posegov vanjo s preiskavami in zasegi, kakor je opredeljeno s četrtim amandmajem k ameriški Ustavi ter precedenčnimi sodbami Vrhovnega sodišča. Predstavimo zgodovinski pregled in razvoj varstva pravice do zasebnosti skozi analizo vodilnih precedenčnih sodb, ki so področje oblikovale. Drugi del zaključnega dela se osredotoča na ureditev področja pravice do zasebnosti z vidika kazenskega procesnega prava v Republiki Sloveniji. Obravnavamo ustavne določbe v zvezi z varstvom pravice do zasebnosti ter določene vodilne odločbe Ustavnega sodišča na tem področju. V nadaljevanju opišemo zgodovinski razvoj akuzatorno-adversarnega in inkvizitornega postopka, na katerih temelji idejna zasnova »mešanega« modela kazenskega postopka, ki je uveljavljen v Sloveniji. Sledi opis posameznih določb v zvezi s preiskavami in zasegi iz Zakona o kazenskem postopku. V zadnjem delu naloge skušamo primerjati ureditvi obeh držav in opredeliti poglavitne razlike pri varstvu pravice do zasebnosti na področju preiskav in zasegov.

Title:Comparing legal framework of search and seizure in american and slovenian criminal procedural law
Abstract:In this thesis we compare the legal frameworks of search and seizure through the lens of the right to privacy in the United States of America and the Republic of Slovenia. In the first part of the thesis we examine the constitutional protection of the right to privacy in criminal procedural law in the United States of America, namely the permissibility of breaching it with searches and seizures as defined in the Fourth Amendment to the American Constitution and precedents of the Supreme Court. We present the historical overview and the development of the right to privacy through analyzing leading precedents that shaped the field. The second part of the thesis focuses on the legal framework of the right to privacy from the perspective of criminal procedural law in the Republic of Slovenia. We examine the constitutional provisions about the right to privacy and certain leading decisions of the Constitutional Court. We continue by describing the historical development of the accusatorial-adversarial and inquisitorial criminal procedure on which the Slovenian mixed model of criminal procedure is based upon. Afterwards we detail the specific provisions concerning search and seizure in the Criminal Procedure Act. Lastly, we compare the frameworks of both countries and determine the main differences in protecting the right to privacy in the context of searches and seizures.
