Title:Javno mnenje o pritožbenem postopku zoper policijo : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomsko delo naslavlja vprašanje javnega mnenja o pritožbenem postopku zoper policijo v Sloveniji. Pritožba zoper policijo je institut, ki se je v Slovenskem prostoru začel pojavljati leta 1998. Leta 2003 sta bila uvedena dva nivoja odločanja o pritožbah – pomiritveni postopek in postopek pred senatom, s čimer je institut pritožbe zoper delo policije začel dobivati podobo, ki jo ima v sedaj veljavni ureditvi. Pritožbeni postopek ureja dvajset določb »Zakon o nalogah in pooblastilih policije« (2013), podrobneje pa tudi »Pravilnik o reševanju pritožb zoper delo policistov« (2013). Občasno se pri delu policistov pojavijo nepravilnosti, ki jih lahko domnevni oškodovanec skladno z zakonodajo prijavi pristojnemu organu, ki je v tem primeru Ministrstvo za notranje zadeve. V okviru ministrstva deluje Sektor za pritožbe zoper policijo, ki neodvisno, nepristransko in strokovno obravnava pritožbe zoper delo policistov. V pritožbenem postopku se torej lahko uveljavlja nestrinjanje z dejanjem ali opustitvijo dejanja policista pri opravljanju policijskih nalog, ki lahko predstavlja kršitev človekovih pravic ali temeljnih svoboščin. Zaključno delo se osredotoča na javno mnenje o postopku. Cilj je bil ugotoviti v kakšni meri splošna javnost postopek pozna in se ga posluži, ter kakšno je njihovo mnenje o postopku. Ugotovitve kažejo, da 70 % splošne javnosti ni seznanjene z načinom vlaganja pritožbe zoper policijo. 9 % anketiranih se je postopka že poslužilo, zadovoljstvo s postopkom pa ni bilo najboljše. Večina meni, da bi postopek lahko izboljšala boljša komunikacija s pristojnimi organi in hitrejše reševanje pritožbe. Poudariti je treba, da je bil odstotek anketiranih, ki so pritožbo že vložili, zelo nizek, kar je treba upoštevati pri interpretaciji rezultatov. Zaključno delo je pokazalo tudi, da področje ponuja še veliko prostora za nadaljne raziskave.

Title:Public views on the complaints procedure against the police
Abstract:The thesis examines the issue of public opinion regarding the complaint procedure against the police in Slovenia. The institution of filing complaints against the police was introduced in Slovenia in 1998. In 2003, a two-tier system of decision-making in complaint procedures was established – a conciliation procedure and proceedings before a panel – thereby shaping the complaint mechanism into the form it has under the current legal framework. The complaint procedure is regulated by twenty provisions of the Police Tasks and Powers Act (2013), and is further specified in the Rules on the Resolution of Complaints against Police Officers (2013). Occasional irregularities in police work may be reported, in accordance with the law, by an alleged injured party to the competent authority, which in this case is the Ministry of the Interior. Within the Ministry, the Sector for Complaints against the Police operates independently, impartially, and professionally in handling such complaints. Through the complaint procedure, individuals may therefore challenge an act or omission by a police officer in the performance of official duties that may amount to a violation of human rights or fundamental freedoms. This thesis focuses on public opinion regarding the procedure. The aim was to determine the extent to which the general public is familiar with the mechanism, whether they make use of it, and how they perceive it. The findings indicate that 70% of the general public are not familiar with the procedure for filing a complaint against the police. Nine percent of respondents had already made use of the procedure; however, satisfaction with the process was relatively low. The majority expressed the view that the procedure could be improved by means of enhanced communication with the competent authorities and more efficient resolution of complaints. It should be noted that the proportion of respondents who had actually filed a complaint was very small, which must be taken into consideration when interpreting the results. The thesis further demonstrates that the field still offers considerable scope for future research.
