Title:Možna vloga detektivov na področju probacije v Sloveniji : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomska naloga preučuje možnosti vključevanja detektivov v sistem probacije v Sloveniji, ki predstavlja alternativo zaporni kazni in temelji na nadzoru ter podpori storilcev kaznivih dejanj. Ugotovitve kažejo, da imajo detektivi po veljavnem zakonu o detektivski dejavnosti že upravičenja, posedujejo pa tudi ključne kompetence, kot npr. ustvarjanje pomembnih informacij iz velike količine podatkov, informacijsko-komunikacijska pismenost, samodisciplina in organizacijske sposobnosti, ki bi jih bilo mogoče, ob dodatnem usposabljanju, učinkovito uporabljati na področju probacije, predvsem pri preverjanju izpolnjevanja obveznosti obsojencev in pri zbiranju podatkov, potrebnih za pripravo probacijskih poročil. Intervjuji s strokovnjaki s področja detektivske dejavnosti in probacije potrjujejo, da bi takšno sodelovanje lahko pomembno razbremenilo probacijske uslužbence, omogočilo boljše delo z obsojenci, hkrati pa povečalo spekter delovnih nalog detektivov. Ključni pogoj za to so tako zakonske kot tudi organizacijske spremembe, ki bi jasno opredelile pristojnosti in omejitve detektivov, zagotovile spoštovanje človekovih pravic ter preprečile morebitne zlorabe. Naloga zato predlaga uvedbo pilotnih projektov, s katerimi bi v praksi preverili možnost sodelovanja, in spodbuja nadaljnje raziskave na tem področju. Končni rezultati namreč kažejo, da bi povezava detektivske dejavnosti in probacije lahko bila koristna za oba sistema, saj bi, ob ustreznih pogojih, lahko prispevala k učinkovitejšemu izvajanju probacije v Sloveniji in zmanjšanju povratništva obsojencev ter detektivom dala več možnosti za delo.

Title:The possible role of detectives in the field of probation in slovenia
Abstract:The thesis examines the possibilities of incorporating detectives into the probation system in Slovenia, which represents an alternative to imprisonment and is based on the supervision and support of offenders. The findings show that detectives already have the necessary authorizations under the current law on detective activities, and they also possess key competencies, such as the ability to extract relevant information from large amounts of data, information and communication literacy, self-discipline, and organizational skills, which, with additional training, could be effectively used in the field of probation, especially in verifying the fulfillment of convicts' obligations and in collecting data necessary for the preparation of probation reports. Interviews with experts in the field of detective work and probation confirm that such cooperation could significantly reduce the workload of probation officers, enable better work with convicts, and at the same time increase the range of tasks performed by detectives. The key prerequisite for this is both legal and organizational changes that would clearly define the powers and limitations of detectives, ensure respect for human rights, and prevent possible abuse. The thesis therefore proposes the introduction of pilot projects to test the possibility of cooperation in practice and encourages further research in this area. The final results show that linking detective work and probation could be beneficial for both systems, as, under the right conditions, it could contribute to more effective probation in Slovenia and reduce recidivism among convicts, while also providing detectives with more opportunities for work.
