Title:Upravičenja detektiva in posegi v človekove pravice : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomsko delo predstavlja detektivsko dejavnost v Republiki Sloveniji, natančneje upravičenja in prepovedi, ki jih detektivu podeljuje oziroma določa zakon. Detektiv pri svojem delu omejen z (ne popolnoma jasnimi) zakonskimi določbami. Te so določene z namenom varstva človekovih pravic in temeljnih pravic tako opazovanih kot tretjih oseb. Ker vsako ravnanje detektiva predstavlja določen poseg v človekove pravice, mora detektiv pri svojem delovanju izbirati načine dela, s katerimi v najmanjši možni meri posega v zasebnost in druge pravice posameznika. Izrecno detektiv ne sme opravljati prikritih preiskovalnih ukrepov, za katere so z zakonom pooblaščeni policija sodišče in drugi pravosodni organi ter varnostno-obveščevalne službe. Žal je praksa pokazala, da je meja med upravičenji detektivov in prikritimi preiskovalnimi ukrepi pogosto zabrisana, po našem mnenju pa bi se težavam lahko ognili z jasnejšimi definicijami in sistemskim pristopom pri oblikovanju samih zakonskih določb. Ker izvajanje upravičenj detektiva lahko predstavlja poseg v ustavno varovano pravico do zasebnosti, mora biti izvajanje teh jasno, določno in natančno opredeljeno v zakonu, detektivi, ki izvršujejo ta upravičenja pa morajo nenazadnje imeti jasno začrtane meje. V vsakem primeru pa ob očitkih spornih ravnanj detektiva končno razlago zakonitosti le teh na koncu poda sodišče. Z vidika sodne prakse so dovoljeni posegi v človekove pravice samo tisti, ki zasledujejo ustavno dopusten cilj in ki nato prestanejo še strogi test sorazmernosti. Če detektiv s svojim ravnanjem nedovoljeno poseže v človekove pravice, tako pridobljenih dokazov ni mogoče uporabiti v nobenem sodnem postopku, tako detektiv kot naročnik pa lahko (glede na stopnjo odgovornosti) za svoje ravnanje kazensko in civilnopravno odgovarjata.

Title:Private detective's entitlements and interference with human rights
Abstract:This thesis presents detective work in the Republic of Slovenia, namely the detectives’ rights and restrictions under the law. The work of detectives is limited with (not entirely clear) legal provisions, which are set out to protect human rights and fundamental rights of surveillance subjects and third parties. As any conduct by a detective constitutes a certain interference with human rights, detectives must choose work methods that interfere as little as possible with the privacy and other rights of individuals. Detectives are prohibited from undertaking secret investigative measures granted by law to police, judiciary, and intelligence and security services. However, practice has shown that the line between the powers of detectives and secret investigative measures is often blurred. We believe that these problems could be avoided with clearer definitions and a systematic approach to the drafting of the legal provisions themselves. Since the exercise of a detective's powers may constitute an interference with the constitutionally protected right to privacy, the exercise of these powers must be clearly, precisely, and accurately defined in law, and detectives exercising these powers must ultimately have clearly defined limits. In any event, when a detective is accused of controversial conduct, the final interpretation of the legality of such conduct is ultimately made by the court. According to case law, only those infringements of human rights that pursue a constitutionally permissible objective and subsequently pass a strict proportionality test are permissible. If a detective's actions constitute an unlawful interference with human rights, the evidence obtained in that manner cannot be used in any court proceedings, and both the detective and the client may be held criminally and civilly liable (depending on the degree of responsibility) for their actions.
