Abstract:Energetska prenova večstanovanjskih stavb z vidika etažne lastnine predstavlja enega izmed osrednjih izzivov pri izvajanju ukrepov za izboljšanje energetske učinkovitosti v stavbnem fondu in doseganju zastavljenih podnebnih ciljev. Pravni okvir sicer spodbuja izboljšanje energetske učinkovitosti, a hkrati razkriva vrsto sistemskih ovir, zlasti pri odločanju večjega števila etažnih lastnikov, neurejenih zemljiškoknjižnih stanjih, pomanjkljivi tehnični podpori ter omejenem dostopu do financiranja. Prenove stavb, ki so del kulturne dediščine, zavzemajo posebno mesto v okviru razprave o energetski sanaciji, saj predstavljajo poseben izziv pri iskanju ravnotežja med varstvom arhitekturnih in zgodovinskih vrednot ter doseganjem sodobnih energetskih standardov, kar pogosto pomeni večjo kompleksnost in potrebo po individualiziranih pristopih. Pridobivanje soglasij etažnih lastnikov za energetsko prenovo ostaja eden ključnih izzivov v praksi. Postopki odločanja so pogosto zapleteni, zlasti v stavbah z razdrobljenim lastništvom. Veljavna zakonodaja zahteva različno stopnjo soglasja glede na vrsto posega, kar odpira vprašanja razlage in uporabe v praksi Financiranje energetske prenove večstanovanjskih stavb zahteva prilagojen, večplasten pristop. Rezervni sklad praviloma ne zadošča za večje naložbe, zato so ključnega pomena dostopni krediti, nepovratne finančne spodbude ter inovativni modeli. Za uspešno prenovo je zato nujno zagotoviti stabilen in pravno predvidljiv okvir, ki bo omogočal tako individualne kot skupnostne finančne rešitve. Energetska prenova večstanovanjskih stavb ni zgolj tehnični izziv, temveč kompleksno pravno in družbeno vprašanje, ki zahteva usklajevanje različnih interesov, vzpostavitev jasnih pravnih mehanizmov ter zagotovitev celovite podpore etažnim lastnikom.

Title:The path to energy efficiency: rights, obligations and challenges of condominium owners : magistrsko delo
Abstract:The energy renovation of condominium buildings represents one of the central challenges in implementing measures to improve energy efficiency in the building stock and in achieving established climate goals. While the legal framework encourages the enhancement of energy performance, it also reveals a number of systemic barriers—particularly in the decision-making processes involving numerous co-owners, Unclear property titles, insufficient technical support, and limited access to financing. The renovation of buildings that are part of cultural heritage holds a special place in the discussion on energy refurbishment, as it presents a particular challenge in balancing the preservation of architectural and historical value with the achievement of modern energy standards. This often entails greater complexity and the need for individualized approaches. Obtaining consent from condominium owners for energy renovation remains one of the key practical challenges. Decision-making procedures are often complex, especially in buildings with fragmented ownership structures. The applicable legislation requires varying levels of consent depending on the type of intervention, which raises issues regarding legal interpretation and implementation in practice. Financing the energy renovation of condominium buildings requires a tailored, multi-layered approach. Reserve funds are generally insufficient for larger investments, making accessible loans, non-repayable financial incentives, and innovative models crucial. A successful renovation therefore depends on establishing a stable and legally predictable framework that enables both individual and collective financial solutions. The energy renovation of condominium buildings is not merely a technical undertaking, but a complex legal and social issue requiring the alignment of diverse interests, the establishment of clear legal mechanisms, and comprehensive support for apartment owners.
